The defense has contended that
Havard believed he was bong fired

In his cross-examination of
Hidalgo, Carter got the police detec

photographs that had previously
been entered as state s evidence

Hidalgo demonstrated several
standard positions an officer might

Blazek asked ffidalgo: "The proper
way to say ‘Freeze!’ has nothing to
do with a stance, does it?”
"No sir." the detective replied
And an officer doesn't have to
wait and draw Ms gm before he says

“That is correct/' said Hidalgo
After Judge Ernst told Hidalgo to
step down from the witness stand, he
asked Carter and co-coonse! Howard
Lake if they were ready to begin
their defense
Lake told Judge Ernst that he
should let the jury go until Monday
because he and Carter had been
handed information which may
change the defense strategy and
maybe even cause them to make a
motion for mistrial.
Because they defense attorneys
were court-appointed, they were
“emitted to some equity,” the judge
noted, and recessed the proceedings
until Monday morning.
Before he released them for the
weekend. Ernst cautioned the jury
to "insulate” themselves as best
they could after they left the jury
room.
“I can’t stress loo strongly that
you refrain from reading accounts of
this case and refrain from discuss-
ing this case wit h anyone.’’ the judge
said.

(Blazek first tried to introduce the

The former ceflmate of Havard
testified that the defendant tried to
escape from the Walker County Jail
shortly after Ms arrest.

former Huntsville resident who was
one of Havard’s cellmates in the
