its owner. This would or ought to induce an examination of the
records showing absolute conveyances, as well at those showing

That heretofore, to-wlt: on the 4th
day of January, A. D. 1909, the Comba
Cattle Company did Grant, Bargain,
Sell and Convey, subject to the ven-
dor's lieo hereinafter recited, to 1. J.
Pierce and G. W. Power, the following
described tracts of land, in Brewster
County, State of Texas, to-wlt:

House in the toon of Alpine,
Texas, in said AJpine Independ-
ent School Dirtnct on the 4th
day of May, 1912, to determine
whether-the board of trustees of
said district shall hare power to
annually levy and collect a tax
upon all taxable property in said
district, for the support and
maintenance of public free schools

Comba Cattle Company the amounts
stipulated in each of said notes respect-
ively, aa hereinafter set out, together
wtth inter eat thereon from January 1st,
1909, at the rate of sight per cent per
annum, interest payable annually and
ten par rent additional as attorney's
fees if notes were placed fa the hands
of an attorney for collection or suit
should he brought thereon, and the
payment of each of which notes was
secured by a vendor's lion expressly
retained upon the above diocribed pro-
perty. Said notes due and payable aa

Note No. 1, due fifteen months after
Janary 1st, 19U9. for $6.000 00;
Note No 2, due eighteen months af-
ter January 1st, 1909, for $5,000.90
Note No. 8, due twenty-one months

Note No. 4, due twenty-four months

In each of which notes it was stipu-
lated and agreed that the same should

the plaintiff acquired a vendor’s lien
upon tlis above diocribed property on
January 4th, 1909, which is a valid and

That notwithstanding said debt ia
loog since due and unpaid, and defend-
ants am. each of them have refused to
pay plaintiff said debt or any part
thereof, except the sum of 91,589.96
paid on December 6th, 1910, to plain- accordance with the special act of
the Legislature incorporating said
Independent School District.
None but property tax payers
who'are qualified voters in said
Alpine Independent School Dis-
trict, shall vote at said election.
