This enso grew out of a proceeding begun
in 1SI1 before Urn Interstate commerce com
mission by tho New York board of ttade
and transportation against a number of
railroad companies among which tho
Texas and Pacltlo was not Included al-
though It was afterward Included It was
claimed that an unjust discrimination wus
mado by railway lines starling at the
eastern seaboard of the United States In
fnor of goods coming from abiond under
a Joint ocean and railroad tariff and
against domestic tariff originating at the
scaboaul nnd going thence to Western
terminals and carried under substantially
similar conditions from such hotboard

companies to discriminate In faor of for-
eign shippers wholly upon Its constiuctloii
of the net and had concluded that It wus
constrained oy the law to regard foreign
and domestic traftlo as nllko in kind un-
der tubstiuulnlly similar circumstances
and conditions In this construction tho
commission had erred It was not Intend-
ed that the commission should regard tho
complaints of only one class of the com-
munity On the continry the commission
Is to consldcT not only tho wishes of the
shippers of tho large cities but also the
desires nnd advantages of tile canters In
seeming siiccial foims of trnftle and tho
Interest of the public He did not accept
the view thut In this legs etion congtess
had any purposo to rclnfoico the pro-
visions of tho tariff laws These laws he
said differ wholly In their objects fiom
he laws to regulate commerce nnd added
The erforts of tho commission to deprive
Inland consumers of the advantage of
thtough rutcs and thus to give an ad
antn o to tho traders and manufactuters

ate tho very mischief which It was one of
tho objects of tho act to remedy
Summing up tho court concluded That
tho putposo of the Interstate commerce
act Is to promote commerce that In pass-
ing upon eiuestloirs under it the commis-
sion and courts aro einpowerwl to consider
nli the clicumstances and conditions that
riasonablv apply lo tho situation and that
In tho exercise of Its Jurlsdli tlon the tri-
bunal mi and flhould consider tho legiti-
mate Interests of all concerned that
