That George W Jackson was named as
ole executor of said will without
bond and the will provided and directed
hit no proceedings in court should be
had other than probating the will That
alter the death of Swartvrelder Jackson
probated the will and obtained possession
of the property which was appraised at
20000 That Jackson eold off part of
the estate and converted the money to
Jiis own use That during the period
Tifrom 1881 to 1S85 when the peti
1 tioner married that he collected the
rents amounting to 2300 per yearwhich
he also misapplied to bis own use That
he borrowed from others 810000 in the
aggregate and by his power of executor
and a power of attorney deceitfully and
frauduletly obtained from his ward as
pretended attorney in fact for her
mortgaged all of her lands to se-
cure these sums of money bor-
rowed for Ms own benettt which
mortgages are still unsatisfied to the
amount of 3000 and constitute a lien on
her lands and subjects them to sale for
the payment of said loans That re
peated demands have been made upon
Jackson for settlement of said trust
mat ers without avail The plaintiffs
sue for amounts alleged appropriated by
Jackson and for the amount of the mort
gages on the lands It is alleged in the
petition that G W Jackson is insolvent
The papers in the above suit have not
as yet been served on Mr Jackson They
were placed in Deputy Sheriff Dee
Cooks hands and failing to llnd Mr
Jackson yesterday afternoon he went to
his residence this morning to serve the
papers Mr Cook was told that Mr
Jickson had gone to Bosque county The
officer could do no more and thus the
matter stands If the papers had been
served today the suit could have been
tried at this term of the District
court but as it is the Ave days of grace
will have elapsed after today and the
case will go over until the October term
of the District court Tun Gazette re
porter made an effort to see Mr Jackson
this morning and have him make a state
ment if he so desired in regard to this
matter but when a reporter called at Mr
Jacksons office the door was locked It
is not known definitely where Mr Jack-
son is or when he will return
Mr Stark West was seen in his fathers
office this morning and he does not hes-
itate to say that Mr Jackson has made
away with the Swartzwelder estate and
appropriated the proceeds to his own
ue and benefit He further states that
he intends to push the suit and sift the
whole matter to the bottom and learn
where tbo property has gone This
Uit has fallen like a bombshell in
the community Mr George W Jackson
has beeri looked upon as 3 thoroughly
honest man by the business men of Waco
and his occupied several responsible
position s He was a partner with the
late Colonel Wm A Fort and for a
jyiajtfer of years ran a banKing house
Stfifler the firm name of Fort
Jack3on When the charter for
the Waco National bank was secured
Mr Jackson was elected cashier which
position he held for several years Since
then lie has been looking after other busi-
ness but principally for the past few
j years has been loaning money and
seemed to have a good run of business
He also occupies a prominent position as-
a membpr of the vestry of St Pauls
church Episcopal His friends are
very anxious he shall return to Waco and
vindicate himself
A warrant has been received here for
the arrest on a charge of assault with in-
tent to murder of Dr E S Jackson a
young doctor who came here two weeks
ago from Shelbyville 111 with his young
wife He refuses to talk about the mat-
ter and has applied for a habeas corpus
hearing whicn will be had next Monday
He does not seem at all alarmed
Governor and Mrs Koss are expected
to arrive from Austin tomorrow to at-

twenty days Cattle here now are getting

heavily Indebted to the brewers for the

A Denial of the Iteport ot Sufferlns
In
the County
Midland Tex Feb 231357
To Uie Editor of the Gazette
The people of Midland hate rather
sraciouly looked upon John Brown of
Albany as a mild sort of crank but his
letter in Saturdays Gazftte shows that
there is venom in his makeup
Every statement he makes concerning
Midland is utterly false Will he answer
theee questions
Who has eaten muleear rabbits and
prairie dogs
What children have sucked old bones
to satisfy hunger
What lady died of poverty
What widow with one child is entirely
destitute
Whose cattle have starved to death i
What family is reduced to bread and
water
There is positively no truth nor sem-
blance of truth in what he says in relation
to these questions Either John Brown
or some unknown Cumberland Presby-
terian is a lying scoundrel
There are no doubt professional mendi-
cants who glory in last years drouth for
it enables them to make their begging
respectable but It is not fa5r for John
Brown or Dr Cooper to take the words
of these people and ignore the statements
of solid businessmen and sworn officials
General Lane of the drouth commis- >
sion was here last week and ascertained
that no relief is needed I
Prosperity is evident on all IftMif at
Midland Three new stores have opened
>
within the last two weeks
is nearly let for another brick building
and everybody is contented and happy
Ther is not a business house in town for
rent and only one or two dwellings The
range is good and stock of all kinds isr
doing well The Texas and PacificJtt
< oad is doubling the depot accoramoda
tione to meet the demands of increasing
business If people cannot make a living
in Shackelford county we invite ihenVto
come west We hope John Brown will
answer the above queries for the fcoke of
his own reputation Midland

COLEMAN CODNTY
The Farmers nae Plenty of 8eed Wheat
and Oats A llrlglit Ontlook
Special to the Gazette
Coleman Tkx March 1 The more
fortunate citizens of Coleman county last
fall furnished the farming class with suf-
ficient seed wheat to seed their land and
ample rains have fallen at intervals to
keep it alive and there are now quite
green wheat fields to be seen in all direc-
tions and in a days ride in the country
one passes many farms with from ten to
fifty acres in wheat looking green
and well We think the present outlook
for wheat and oats the best we have ever
had in this county The same fortunate
citizens have recently famished every
farmer in Coleman county making appli-
cation sufficient seed oats to seed his
land taking his notes for the same paya-
ble September 1 We are informed by
Messrs Lancaster Moffitt that abou >
5000 bushels of oats have been delivered
to farmers and some has been refused
Grass is putting out and cattle and
sheep are doing well and the present
situation is very hopeful
