bunal for tho arbitration of differences

vent the frequent recurrence of such dis-

ent January 20 187C Ho did not declare
that his Invention had anything to do
with tho moans of transmitting articulate
speech by electricity but described It as
an Improvement in telegraphy On tho

a slight improvement on Ids former sys-
tem of telegraphy but yet made no claim
that he could transmit articulate speech
On the same day 1rof Ellsha Gray tiled
a caveat for an invention expressly de-
clared to be to transmit tho tones of tho
human voice through a telegraphic cir-
cuit and reproduce them at tho receiving
end of tho lino so that actual conversa-
tion can bo carried ou by persons a long
distance apart This caveat was filed
prior to Bells application for a patent
Ey law Gray was entitled to have his
caveat preserved In secrecy Despite tho
statutory requirement of secrecy tho
examining olllccr of tho patentofllco
communicated to Bell tho fact of tho
tiling of Grays caveat as well as the
general nature of the claim made In It
and some Information of tho particular
method employed Bell followed up this
knowledge and Induced somo of tho pat
ent olllcors to further violate tho require-
ment of secrecy by setting on foot an In
quiry for Bells benellt as to tho precise
time of day when Grays caveat was Hied
and thereupon without any certain
proof and contrary to law and tho custom
of tho olllce It was determined contrary
to fact that said caveat was tiled after
said application although tho same day
Tho patent olllco examiner who had tho
matter lu charge without letting Gray
know of tho question that had been raised
as to the time of llllug or of Its determi-
nation and without giving him an oppor-
tunity to prove tho time of filing his
ca eat announced to him Feb 2S 187G
that tho notice sent him had been glvou
him under a misapprehension and was
withdrawn
It was the 7th of March following that
a patent was issued to Bell covering his
amended application for a patent for
transmitting speech but not until tho
10th of that month did ho over obtain
articulate speech by an electricspeaking
telephone This was not achieved by
any dovieo or apparatus described in his
specltlcatlou or patent but was obtained
by the liquid transmitter or wntor tele
phone described In Grays caveat and de
rived by Bell from tho latter Bells de-
vices up to tho time of filing his applica-
tion did not transmit and deliver articu-
late speech Ho did not intend ho to
operate them nor was heawarc that thoy
would do so Theio is not and never
was it is deelaied an electricspeaking

with Hells alleged invention aud the In-
strument used by tho Amorican Boll com-
pany was not Invented or discovered by
Bell Thcso are only a part of the alle-
gations of fraud on tho part of Boll to

persons in this country aud Europe who
used tho device for speaking by telephono

Tho prayer of tho complaint is that upon
proof of tho facts alleged it be declared
that tho patents wero wrongfully pro-
cured to bo Issued by means of fraud

wrong and that thoy bo declared null

mere annulment of the patents If thoy

six or seven hundred souls granting that
they all have souls which is doubtful
But some of them havo enough surplus
to make a good average all round Tho

enough for a population tenfold greater
Most of the houses aro plain but well

comfort about the residences not common
in tho now towns of the West This is
owing to the shadetrees shrubbery and
flowergardens in which many of them aro
