HOUSE JOINT RESOLUTION
proposing an amendment to Ar-
ticle VIII of the Constitution of
the State of Texas by adding there-
to a new section to be known as
“Section 7-a”; providing that sub-
ject to legislative appropriation,
allocation and direction all net
revenues derived from the taxes,
except gross production and ad va-
lorem taxes, levied on motor fuels
and lubricants and motor vehicles
registration fees shall be used for
the sole purposes of acquiring
rights-of-way for and constructing
and maintaining public roadways;
for the administration of laws per-
taining to traffic and safety; and
for the payment of principal and]
interest on county and road dis-
trict bonds or warrants voted or
issued prior to January 2, 1939, and
declared eligible for debt service
prior to January 2, 1945; provid-
ing that one-fourth (1/4) of such
net revenue from the motor fuel tax
shall be allocated to the Avail-ole
School Fund; providing and insur-
ing that each county shall never
derive less revenue from motor
registration fees than the maximum
amounts and percentages of such
fees allowed to be retained by each
county under the laws in effect on
January 1, 1945; negativing any
interpretation of this amendment as
authorizing the pledging of the
State’s credit for any purpose; pro-
viding for the submission of this
amendment to the voters of this
State; prescribing the form of bal-
lot; and providing for the procla-
mation of the election and the pub-
lication thereof.
BE IT RESOLVED BY THE
LEGISLATURE OF THE STATE
OF TEXAS:
Section 1. That Article VIII of
the Constitution of the State of
Texas be amended by adding there-
to a new Section to be known as
‘7-a and to read as follows:
“Section 7-a- Subject to legisla-
tive appropriation, allocation and
direction, all net revenues remain-
ing after payment of all refunds al-
lowed by law and expenses of col-
lection derived from motor vehicle
registration fees, and all taxes, ex-
cept gross production and ad va-
lorem taxes, on motor fuels and lub-
ricants used to propel motor ve-
hicles over public road ways, shall
be used for the sole purpose of ac-
quiring rights-of-way, construct-
ing, maintaining, and policing such
public roadways, and for the ad-
ministration of such laws as may
be prescribed by the Legislature
pertaining to the supervision of
traffic and safety on such roads;
and for the payment of the prin-
cipal and interest on county and
road district bonds or warrants
voted or issued prior to January 2,
1939, and declared eligible prior to
January 2, 1945, for payment out
of the County and Road District
Highway Fund under existing law;
provided, however, that one-fourth
(14) of such net revenue from the
motor fuel tax shall be allocated
to the Available School Fund; and,
provided, however, that the net
revenue derived by counties from
motor vehicle registration fees
shall never be less than the maxi-
mum amounts allowed to be retain-
ed by each County and the percent-
age allowed to be retained by each
County under the laws in effect on
January 1, 1945. Nothing contained
herein shall be construed as au-
thorizing the pledging of the
State’s credit for any purpose.”
Sec. 2. The foregoing Amend-
ment to the Constitution shall be
submitted to a vote of the qualified
electors of this State at the Gen-
eral Election to be held in Novem-
ber, 1946, at which election each
ballot shall have printed thereon
the following words:
“FOR the Amendment to the
Constitution of the State providing
that subject to legislative appro-
priation, allocation and direction all
net revenues derived from taxes,
except gross production and ad va-
lorem taxes, levied on motor fuels
and lubricants and motor vehicle
registration fees shall be used for
the sole purposes of acquiring
rights-of-way for and constructing
and maintaining public roadways;
for the administration of laws per-
taining to traffic and safety; and
for the payment of principal and
interest on county and road district
bonds or warrants voted or issued
prior to January 2, 1939, and de-
clared eligible for debt service prior
to January 2, 1945; providing that
one-fourth (14) of such net rev-
enue from the motor fuel tax shall
be allocated to the Available School
Fund; providing and insuring that
each county shall never derive less
revenue from motor registration

poses of acquiring righ^s-of-way

fic and safety; and for the pay-
ment of principal and interest on
county and road district bonds or
warrants voted or issued prior to
January 2, 1939, and declared eli-

“Each voter shall strike out with
pen or pencil the clause which he
desires to vote against so as to
indicate whether he is voting FOR
or AGAINST said proposed amend-
ment.”
Sec. 3. The Governor of the State
of Texas is hereby directed to is-
sue the necessary proclamation for
said election and to have same pub-
lished as required by the Consti-
tution for Amendments thereto.

Corporal Charles W. Bluhm left
last Friday for Fort Dix, New Jer-
sey, where he will be stationed.
Voting was very light in the
election here last Saturday. Only
thirty-seven votes were cast.
Mr. and Mrs- Lawrence Jackson
and children of San Antonio were
guests in the Joe Berends home
last week.
Austin.—Allan Shivers, dean of
the State Senate, lawyer-farmer
and combat war veteran, who is
one of the runoff candidates for
lieutenant governor, said here to-
day that “I am deeply grateful for
the loyalty and support which has
been given me by the people of
Texas.”
“I shall conduct my runoff cam-
paign on the same high plane as
the one completed last week,” he
added, “and will continue to run on
my record of experience and quali-
fications.”

arrived last week to spend several
weeks with her son-in-law and

The Refugio County Home Dem-
onstration Council met in the Home
Demonstration agent’s office on
July 25 at 2:30 o’clock. Five mem-
bers were present.
Mrs. Emil Leister, marketing
chairman, gave a report of the pool-
ed orders for pineapple. She stated
that orders are being taken for
nuway coat hangers.
Final plans were made for the
annual tea for all Demonstration
club members, to be held in Re-
fugio August 22 from 3:30 to 5
o’clock.
Mrs. H. R. Pfullman was elected
delegate to the Texas Home Dem-
onstration Association convention,
which meets at Amarillo in August
with Mrs. L> R. Schorlemmer as
alternate.
The council voted to defray the
expense of the delegate to the state
convention.

authorizing the Legislature to ap-
propriate Seventy-five Thousand
($75,000.00) Dollars, or so much
thereof as may be necessary, to pay
claims incurred by John Tarleton
Agricultural College for the con-
struction of a building on the cam-
pus of such college pursuant to de-
ficiency authorization of the Gov-
ernor of Texas on August 31, 1937.
BE IT RESOLVED BY THE

OF TEXAS:
Section 1. That the Constitution
of the State of Texas be amended !
by adding a new section, as fol-

ty-five Thousand ($75,000.00) Dol-
lars, to pay claims incurred by
John Tarleton Agricultural College
for the construction of a building 1
on the campus of such college pur-
suant to deficiency authorization by
the Governor of Texas on August
31, 1937.”
Sec- 2. The foregoing Constitu-
tional Amendment shall be submit-
ted to a vote of the qualified elec-
tors of this state at the next gen-
eral election to be held on the first
Tuesday after the first Monday in
November, A. D., 1946, at which all
ballots shall have printed thereon:
“FOR THE CONSTITUTIONAL
AMENDMENT AUTHORIZING
THE LEGISLATURE TO PAY
FOR BUILDING CONSTRUCTED
FOR JOHN TARLETON AGRI-
CULTURAL COLLEGE”; and
“AGAINST THE CONSTITU-
TIONAL AMENDMENT AUTH-
ORIZING THE LEGISLATURE
TO PAY FOR BUILDING CON-
STRUCTED FOR JOHN TARLE-
TON AGRICULTURAL COL-
LEGE.”
Each voter shall mark out one of
said clauses on the ballot, leaving
the one expressing his vote on the
proposed amendment.
Sec. 3. The Governor shall issue
the necessary proclamation for said
election and have the same publish-
ed as required by the Constitution
-and laws of this state.
