trust by PHILLIP D. SPICER for Mary Elizabeth Failor Barrett.
The Court finds that said constructive trusts wherein
PHILLIP D. SPICER, individually, NEWORTH PROPERTIES CORPORATION,
and ANDERTON-NEWORTH, a Partnership hold such properties
in trust for Mary Elizabeth Failor Barrett should in all
respects be terminated, and all right, title and interest in
said properties of PHILLIP D. SPICER, individually, NEWORTH
PROPERTIES CORPORATION and ANDERTON-NEWORTH, a Partnership
should be in ROBERT J. GIEB, Guardian of the Estate of Mary
Elizabeth Failor Barrett's name.
IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that
the real property listed herein is held in trust by the
Respondents, PHILLIP D. SPICER, individually, NEWORTH PRO-
PERTIES CORPORATION and ANDERTON-NEWORTH, a Partnership,
for the benefit and legal ownership of Mary Elizabeth Pailor
Barrett. The properties are:
1. 804, 808 and 816 Grainger, more fully described
as Lots 8, 9 and 11, Block 4, GRAINGER'S ADDITION
to the City of Fort Worth, Tarrant County, Texas,
according to Plat recorded in Volume 31, Page
405, Deed Records of Tarrant County, Texas.
2. 3324 South Jennings Avenue, more fully described
as Lot 18, Block 50, SOUTH HEMPHILL HEIGHTS, an
Addition of the City of Fort Worth, Tarrant County,
Texas, according to Plat recorded in Volume 106,
Page 132, Plat Records, Tarrant County, Texas.
3. 821 Grainger, more fully described as Lot 12,
Block 3, GRAINGER'S ADDITION .to the City of Fort
Worth, Tarrant County, Texas,'according.to the
Plat recorded in Volume 11, Page 405, Deed Records,
Tarrant County, Texas: SAVE AND EXCEPT that portion
conveyed to the City of Fort Worth, by Deed, dated
3/16/77, filed 3/31/77, recorded in Volume 6204,
Page 414, Deed Records, Tarrant County, Texas.
4. 1004 Travis, more fully described as Lot 21,
PARKS SUBDIVISION of Block 4, FIELD-WELCH ADDITION,
an Addition to the City of Fort Worth, Tarrant
County, Texas, according to Plat recorded in Volume
33, Page 281, Deed Records of Tarrant County, Texas.
5. 2814 and 2816 Merrimac, more fully described as
Lot 4, Block 15, LINWOOD, hn',Addition to the City
of Fort Worth, Tarrant County, Texas, according to
Plat recorded in Volume 388-B, Page 181, Deed
Records of ant County, Texas.
