50 GENERAL LAWS.
xiill and testament, which was duly probated in the county court of
Palo Pinto county, Texas, on October 7, 1895, and which provided
among other things for the establishment, out of part of his estate, of
the above mentioned college, in the following language, to-wit:
Item 5th. "I desire and direct that my executor herein named shall
sell all the remainder of my property, real, personal, and mixed, and
wheresoever in the United States the same may be situated and convert
the same into cash or solvent interest bearing vendors lien notes, as soon
as practicable, and the proceeds of such sales, I give, bequeath and demise
to Thos. B. King, county judge of Erath county, Texas; C. A. Culberson,
Governor of the State of Texas, and the Superintendent of Public Instruction
of the State of Texas, and to their successors in office forever,
in. trust however, for the following purposes, to-wit: I desire and direct
that with such funds my trustees shall erect, endow and maintain, in the
city of Stephenville, in Erath county, Texas, an institution of learning,
to be known as 'The John Tarleton College,' and to be maintained for
the education of such children, resident citizens of said Erath county,
over six and under eighteen years of age, of good moral character and
unable to educate themselves, as my said trustees may select. And I
desire and direct that said fund shall be so divided that the interest on
the portion not used in the construction of the building shall alone or in
connection with any funds derived from tuition or any other source,
maintain an institution of learning, without having to draw upon the
principal, which I desire to be held as a perpetual fund, for the maintenance
of said Institution."
And, whereas, pursuant to the provisions of said will, the said
trustees therein named, the Governor of the State of Texas, the Superintendent
of Public Instruction of the State of Texas, and the county
judge of Erath county Texas, soon after the probate of said will, proceeded
to purchase grounds, erect suitable buildings thereon, and maintain
from year to year an institution of learning, in accordance with the
provisions of said will, and,
Whereas, since the establishment of said institution, other persons by
will and by donation have contributed many thousands of dollars to the
same, which has been invested in part in improvements upon the grounds
belonging to said institution, and which is in part now held by said
trustees, and
Whereas, after a number of years experience in the administration of
the affairs of said institution, the present trustees and their predecessors
in office, have come to the conclusion that the duties of their respective
offices are so onerous and imperative as to preclude the possibility
of their giving to said institution that time and attention which a
proper administration of its affairs demand, for which reason the present
trustees request and desire that the Legislature of the State of Texas
take some steps to relieve them from the duties imposed upon them by
the terms of said will as above set cut, and suggest that, the. control,
management and title of said institution be vested in a board of regents,
who will have the time, ability and inclination to administer the affairs
of said institution in accordance with said will, said board to be appointed
by the present board of said institution, now, therefore:
