awarded by the Commissioner of the General Land Office, after the cancelation
by him of a prior erroneous award, to third parties; and who
has been compelled to defend a lawsuit to obtain title to, or possession of
said land because of such erroneous award, or awards of said land,
made by the Commissioner of the General Land Office, to an adverse
party or parties; shall in making proof of occupancy of said land, be
entitled to credit for the full time said land was in litigation, and from
the date of the applications to purchase were filed as a result of said
erroneous award or awards; and, be it further provided, that the party
to whom the land should have been awarded, in the first instance, in
estimating the cost of the improvements required by law to be put upon
said land; shall be entitled to credit for the value of all improvements
placed on said land subsequent to January 1st, 1907, and prior to
January 1st, 1913.
SEC. 2. The fact that there are settlers on public lands, who have
been prevented from occupying lands purchased by them, by reason of
pending suits, and who are liable to lose such lands; creates an emergency
and an imperative public necessity, that the constitutional rule requiring
bills to be read on three several days, be suspended, and that this
Act, take effect from and after its passage, and it is so enacted.

20, nays 1; and passed the House of Representatives March 19, 1913,
but no vote given.]

S. B. No. 239.] CHAPTER 36.
An Act to amend Subdivision 60, of Article 1121, of Chapter 2, of Title 25, of
the Revised Civil Statutes of Texas, of 1911, adopted at the regular session
of the Thirty-second Legislature, and authorizing the formation of corporations
for the construction and operation of interurban, electric, gas or gasoline,
denatured alcohol or naphtha motor railways, with pqwer to own, construct
and operate union depots and office buildings, and authorizing those
heretofore organized to own and operate office buildings, and providing the
method for amending their charters so as to expressly include such authority.
Be it enacted by the Legislature of the Stfate of Texas:
SECTION 1. That subdivision 60, of Article 1121, of Chapter 2, of
Title 25, of Revised Civil Statutes of the State of Texas adopted by Act
passed at the regular session of the Thirty-second Legislature, A. D.
1911, be amended so as hereafter to read as follows:
Section 60. The construction acquiring, maintaining, and operating
lines of electric, gas or gasoline, denatured alcohol, or naptha motor railways,
within and between any cities or towns in this State, for the transportation
of freight or passengers, or both, with power also to construct,
own and operate union depots and office buildings for their own use. But
no electric, gas or gasoline, denatured alcohol, or naptha railways incorporated
under this subdivision shall ever be exempt from the payment
