Whereas an order of sale was issued
out of the District Court of Freestone
oounty on the 11th day of Mar. 1904, in
the case of John Riley vs. Bird Willis,
East Willis, Mary Eagon and John Ea
gon, in cause No. 3428, same being on a
judgment in favor of plaintiff, John
Riley, and agajnst Bird Willis for
♦156.20, and agittnst Mary Eagon and
Jim Eagon for the Am of $78.10, with
a foreclosure of the vendors liens as
against Bird Willis, East willis and
Mary and Jim Eagon each against three
separate tracts of land of 73* acres each
to be designated and surveyed by de-
fendant Anderson Willis out of a 320
acre tract known as the Stephen Bynum
survey situated in Freestone oounty,
Texas, about 12 miles s 54 e from Fair-
field and known as the Anderson willis
farm on Keechi creek. The said Ander-
son willis having been ordered by the
Court to designate and survey the said
three tracts and upon his failure so to
do I a sheriff will proceed to have same
designated and surveyed prior to the
day of sale and will, on the first Tues-
day, the 3rd day of May 1904, sell to the
highest bidder for cash before the court
house door in Fairfield the three separ-
ate tracts of 734 acres each out of said
Bynum survey. Same being sold separ-
ately to satisfy the said judgments
against Bird and East willis for 1156.20
each, and costs, and against the said
Mary and Jim Eagon to satisfy the said
judgment for $78.10 and costs, either of
said defendants having the right to re-
deem his 734 acres after survey thereof
and priorto sale, by paying the judg-

Whereas by virtue of a certain order
of sale issued out of the District Court
of Freestone county, on the 12th day of
Mar. 1904, in the case of John Riley vs.
Anderson Willis, Ellie Willis and Berry
Willis, and directed and delivered to
me as Sheriff of Freestone county. I
will sell to the highest bidder for cash
before the court house door in the town
of Fairfield, on the 1st Tuesday, the 3rd
day of May 1901, one tract of land
known as tiie w. D. Harris survey, con-
taining 100 acres and one tract of land
mown as the John Q. Cooper 320 acre
survey, to is 58 acres out of the s w cor
of same, heretofore conveyed by deft.,
Anderson Willis to R. M. Edwards,
said two tracts lying on Keechi creek
about 11 miles s 54 e from Fairfield and
adjoining, known as the Willis farm.
Said land will be sold to satisfy a mort
gage lien for $291.80 and the further
sum of $258.80, both said sums bearing
interest at the rate of 10 per cent from
Feb. 16th, 1904, and for the sum of
$117.98 bearing interest, at « «... ,.ent
from Feb. 16th 1904, all adjudged_______
against defendant, Anderson Willis an*1
with costs of suit. Said last mentioned
sums secured by vendors liens against
the defendants Ellie Willis and Berry
Willis who have purchased from raid
Anderson Willis a part of said land sub-
ject to said mortgage lien and whom
judgment is rendered against for the
sum of $156.20 each, with a foreclosure
of the vendors lien, same having been
transferred to plaintiff, John Riley, to
secure said sums of $258.80 and $117.98.
The proceeds of sale of said land will
first be applied the extinguishment of
said mortgage lien and then to the pay-
ment of the balance due plaintiff, and
all costs.
This the 17th day of Mar. 1904.
