By melting publication of this
citation once esch week for eight
successive weeks previous to its
return dsy in some newspaper
published in Cooke county, Tex-
as, yon are hereby commanded
to summon the heirs of Calvin
Williams, their names oeing un-
known. io be and appear before
the District court of said Cooke
county at its next regular term
to be held at the court house in
Gainesville .on Monday, the 29th
day of October* 1900, then and
therb to answer plaintiff’s petition
file No. 7213 filed in said court on
the 22nd day of March, 1906,
wherein J. T. Murphy is plaintiff
and the heirs of said Calvin Will-
iams are defendants, and where-
in it is alleged in substance that
plaintiff is the owner in fee sim-
ple and in the actual possession
of 245 acres of land out of a sur-
rey of 640 acres situated in
Cooke county. Texas, about 18i
miles south 53 degrees west 01
Gainesville patented on April 6,
1857 to Solomon M- Grigsby,
patent No. 938, Vol. 15, Abstract
No. 406, and afterwards on the
27th day of May, 1862, conveyed
by the said Grigsby through his
attorney in fact O. A. Cogburn to
said Calvin Williams;
And the plaintiff and those
whose estate he has have had
peaceable and continuous adverse
possession of said 245 acres, cul-
tivating, using and enjoying the
same, claiming a good and per-
fect title thereto under deeds
duly registered and paying all
taxes thereon for a period of ex-
ceeding twenty years next pre-
ceding the firing of said petition,
and that plaintiff has thus ac-
quired and in possessed of a valid
title to said land under the five
and ten years periods of limita-
tion, superior to all claims, but
that the said Williams has been
long dead and his interesfiif any,
has descended to his legal heirs
and representatives who are un-
known to the plaintiff-
And that there is no deed of
record showing that the said
Williams ever parted with his
interest in said land, and no such
deed is in existence to the knowl-
edge of plaintiff, but that he long
since conveyed said land to those
under whom plaintiff claims but
said conveyance can not now be
proven:
And that while plaintiff is the
true ownet of said land and in
the possession of the same, said
deed to the said Williams and the
unfounded claim of bis heirs cast
a cloud upon plaintiff’s title and
depreciates its value and pre-
vents him from selling same.
The plaintiff prays for judgment
decreeing him to be the owner
of said land and removing all
clouds from his title and for such
other relief as he may be entitled
to in the premises.
Herein fail not, but of this writ
make due return as the law
directs.
