Pursuant to Section 134.128 - .134 of the Texas Surface Coal Mining and
Reclamation Act, TEX. NAT. RES. CODE ANN. (Vernon 2015) and Section
12.312 - .313 of the Coal Mining Regulations, Tex. R.R. Comm’n, 16 TEX.
ADMIN. CODE Ch. 12 (West Group 2015), Luminant Mining Company LLC,
1601 Bryan Street, Dallas, Texas 75201, has submitted its application to the
Railroad Commission of Texas for partial release of reclamation performance
bond obligations for a portion of its Oak Hill Mine Permit No. 46C in Rusk
County, Texas. The Oak Hill Mine permit area is located in Rusk County, Texas,
approximately three miles northeast of Henderson, Texas. Permit No. 46C was
most recently renewed on May 24, 2013, and the most recent bond for the permit
was approved in the form of a blanket collateral bond on June 17, 2014.
The applicant requests a release of Phase I (60%) reclamation obligations on
l,529.7acres, Phases II & III (40%) reclamation obligations on 632.4 acres,
and Phase III (15%) reclamation obligations on 2.0 acres. Phase I requires the
completion of backfilling and regarding. Phase II requires that revegetation has
been established, and Phase III requirements include the completion of both the
Extended Responsibility Period (ERP) and all reclamation activities including
surface water and groundwater requirements. The areas requested are shown on
the map printed with this public notice. Mining operations were conducted on
the 2,164.1 acres in 1988 - 2010. Final grading was accomplished on these areas
in 1988-2011, and vegetation was planted in 1988-2014. Coastal bermudagrass
was planted for pastureland areas, fish and wildlife areas were planted in native
trees, shrubs, and grasses and pine trees were planted in forestry areas. The
approved postmine land use for this acreage is pastureland (64.6 acres), fish and
wildlife habitat (573.3 acres), developed water resources (83.2 acres), forestry
(1,370.2 acres), and industrial/commercial (72.8 acres). These areas were
accepted by the Commission into the five (5) year extended responsibility period
Portions of the area requested for release were used as a waste disposal sites in
accordance with Railroad Commission of Texas (RCT) and Texas Commission
on Environmental Quality (TCEQ) regulations. These areas have been deed-
recorded with the county deed records as waste management units for Class III
(non-hazardous) waste and registered with the TCEQ.
The accepted bond for Permit No. 46C is covered in the form of a blanket
collateral bond in the amount of $1,100,000,000. The applicant does not seek
adjustment to the approved bond as a result of this application; however, an
eligible bond reduction amount may be determined.
