Coleman Smith of CSP said the
matter could be an election issue.
“If I were running (for the MUD
board). I'd certainly raise the ques-
tion that the plant may have to be
removed " Smith added the money
the MUD is spending from uncom-
mitted bond funds "might in-
fluence the outcome of our case"
before it goes to trial.
MUD president Paul McDaniel
said there is no increase in capaci-
ty or size planned for the Sailfish
plant, but the MUD wants “to keep
it in good operating order,” and

It's spring, and thoughts turn inevitably to baseball and garage
sales, especially to benefit local organizations In fact, three sales
are planned in the next few weeks So dig out all those unwanted
items and give them to the Bee Cave Senior Citizens, the Ladies
Auxiliary of the Hudson Bend Volunteer Fire Department
(HBVFD) or the Women s Auxiliary of the Pedernales Volunteer
Fire Department (PVFD). All are seeking both donations for the
sales and customers to buy

maintenance of the plant.
CSP attorney Dave Frederick
said the MUD’s SI29,000 for the
plant improvements “is not just
maintenance, it’s much more in the
nature of an upgrade.” He said his
clients "shouldn't be subjected to
the harassment of construction dur-
ing this spring." at a time just
before the June 27 trial
Members of CSP want the plant
removed, claiming it should never
have been there in its present state
because of past promises by MUD
officials. MUD directors say the
CSP “has no standing " legally
because they are not district
residents or taxpayers.
the improvements “have been
needed for 15 years."
Improvements planned this year
include enlarging a sludge pond,
paving a side street, replacing some
plant components, painting the ex-
terior facilities, and doing some
miscellaneous renovation and
repair work. MUD engineer Roger
Palmer said the district will receive
bids for the work April 11. and
plans to award a contract April 13.
Members of CSP say the plant is
not necessary at all now that the
MUD has constructed a central
water treatment plant at the end of
World of Tennis Boulevard, an
assertion MUD officials dispute.
"If anything happens to either of
our other two plants, we could be
in trouble." McDaniel said “We
could be in a position we could
need the Sailfish plant this sum-
mer."
Directors of the MUD wanted to
make improvements to the plant
this winter, but the Texas Water
Commission didn't release the
funds for the project until March
“We shouldn't have it out of ser-
vice during the summer." said
Palmer "We re cutting it close
now w ith some of the work exten-
ding until June

The Sailfish Water Treatment
Plant, which sits on a 2.2-acre site
off Sailfish Drive, has been a
source of controversy since the
Lakeway Company sold the land to
the MUD in 1972. Some village
residents say the plant was de-
signed to be temporary and the site
dedicated as parkland. Although
the Village of Lake way dropped its
lawsuit against the MUD in
February of last year, the CSP has
tried to have a judge hear the case
since 1980 A district judge may
rule on the case before the trial set
for this June
Part of the settlement agreement
with the village prohibits the MUD
from expanding the plant until
August 1988 The village approved
a building permit last month to the
MUD for landscaping and
