Irion League of land, which is situa-
ted in the counties of Hardin, Liberty,
and Polk in the State of Texas, and

subdivision of said league containing
1000 acres and at the northeast cor-
ner of a survey of 228 9-10 acres out
of the south end of said 1000 acres
and at the northeast corner of a sub-
division made for S. E. Rodgers, a
stake from which a pine 8 inqhes in
diameter bears north 22 1-2 west 6
varas,. and a pine 6 inches diameter
bears north 5 west 8 varas. Thence
north with East line of said 1000 acres
subdivision at 1061 varas branch 2

Texas, as grantee, defendants, and to

Notice Is Hereby Given that W. T.
McNeill, executor, plaintiff, has filed
interrogatories in a certain suit pend-
ing in tJhe District Court of Hardin
County, Texas, wherein the original
parties are W. T. McNeill, plaintiff
and Anna Lundvall, if living, and if
dead her unknown heirs, executors,
administrators, legal representatives,
successors and assigns, surviving
spouses, if any, of the said unknown
heirs, successors and assigns and the
guardians, legal representatives, exe-
cutors, admiriistrators,. heir^ succes-
sors or assigns of said unknown heirs
value of

in the alternative
plaintiff, Mrs. Bertha Quinn, owns said
above described lands in fee simple by
and under a regular chain of title
from the sovereignty of the soil, such
regular chain of title being fully set
out in plaintiffs’ Original Petiton, now
on file with the Clerk of said Court,
and that the defendants are asserting
some character of claim to said land,
which claim is unknown to plaintiffs,
and is unfounded, and which claim is
a cloud on plaintiff’s title and plain-
tiffs also plead the three, five, ten,
and twenty-five year statutes of lim-
itation in support of their record title.
Plaintiffs further represent to the
Court that on the 13th day of June
1918, the said S. E. Rodgers and Wal-
ter A. Brannen made, executed and
delivered to the said Trinity River Oil
Company a mineral lease for the per-
iod of ninety nine years from the date
of said conveyances on eighteen hun-
dred sixty-five (1865) acres of land
of which the above described tract is
a part, which said lease is recorded
in Volume 155, page 444, of the Deed
Records of Liberty County, Texas
and that said Trinity River Oil Com-
pany was to pay one-eighth royalty
on all oil, gas, and other minerals
produced from said land. That the
primary consideration for the making
of said oil, gas, and mineral lease
that the Trinity River Oil Com-
pany would reasonably and with dili-
gence develop the property for oil,
gas, and other minerals! that al-
though said lease was executed foui-
teen years ago, no development has
taken place on said land, nor has •
there been any effort made by the
Trinity River Oil Company, its suc-
cessors or assigns, to develop sa.d
property for oil, gas, or other mine-
rals, that said Trinity River Od Com-
pany is now a defunct corporation,
and is no longer a legal entity, and
is therefore unable to carry out any
of the agreements
