an unjust discrimination against job-

territory and also put the jobbing cen-

competing with out-of-the-State job-

On the whole, it appears that in re-

Judge J. E. Yantis, associate justice
of the Supreme Court, today tendered
his resignation to Governor Hobby to
become effective March 31. Judge Yan-
tin, whose, home is at Waco, resigns
his position on the bench On account
of continued ill health. Ile will re-
turn to his home and practice law.
Judge Yantis was appointed in May,
1915, as a member of the court to fill
a vacancy which existed as a result
of the death of Chief Justice Brown.
This is the text of the commanica-
tion of Judge Yantis tendering his res-
ignation to the Governor;
"I hereby tender to the people of
Texas, through you, my resignation
as associate justice of the Supreme
Court of Texas.
“I was voluntarily tendered the ap-
pointment by Governor Ferguson upon
tlie death of Judge Brown, which oc-
curred during May, 1915 Afterwards
I was nominated in the Democratio
primary to this position, without mak-
ing a single speech or giving a line of
interview to any newspaper in my be-
half- I was suhsequently elected by
the usual Democratic majority. I have
yet to serve five yeas; but sickness
prevents me from so doing.
"1’pon the 20th day of June last,
while undergoing an operation having
my tonsils removed, I suffered a stroke
of apoplexy. I have not sufficienily
recovered to do the heavy work re-
quired of a member of this court. Phy-
sicians have advised me that it usually
requires one year of perfect rest and
quiet to recover completely. I have
been unwilling to acept their advice
on this, with the result that each time
h have violated their instructions in
resuming my work I have suffered a
relapse as a penalty.
"It does not cozport with my ideas
of right to longer draw the salary of
the office and yet discharge so little
of the duties as I have been able to do
since my illness. I feel that I should
give way to some other person whom
you may see fit to appoint.
"My resignation will take effect from
March 31, 1918. This will give you
time to select your appointee and will
give him time to arrange his personal
and private affairs before taking his
place on the court.
"I wish to thank the people of Texas,
