CHAPTER 4
ANIMAL CONTROL
ARTICLE 1. CONTROL OF DOGS
AND OTHER ANIMALS
Sec. 4.1. Definitions
Owner of any dog or other common
household pet shall mean any person
owning, keeping or harboring such dog or
peL (Ord. of 5-20-80).
Sec. 4.2 Vaccination Requirements
The owner of any dog kept within the
city limits shaH cause such dog to be vac-
cinated for rabies and registered by a li-
censed veterinarian. Every such dog
shall be vaccinated for rabies between
the age of three (3) months and six (6)
months, and re-vaccinated every twelve
(12) months thereafter. The owner of any
dog kept within the city limits shall cause
such dog to be vaccinated for rabies and
registered by a licensed veterinarian no
less than once every twelve (12) months.
As used in this section, the term "vaccina-
tion" is defined as an injection of anti-
rabies vaccine approved by the State
Veterinarian. (Old. of 5-20-80)
Sec. 4.3: Tag Requirements
A metal tag shall be issued by the vet-
erinarian vaccinating any dog for rabies,
and the owner of such dog shall cause
said tag to be fastened to the collar of the
dog and worn constantly by the dog. Vet-
erinarians performing such vaccination
shall keep a complete and accurate rec-
ord thereof, showing the date of vaccina-
tion, description of the dog vaccinated
and serial number of the tag issued. (Ord.

Sec. 4.4. Running at Large
The owner of any dog or other com-
mon household pet shall not permit such
dog or pet to run at large within the city
limits. A dog or other common household
pet shall be deemed to be "at Large" if off
the premises of its owner and not under
the immediate control of a person. Any
dog or other common household pet found
to be at large may be seized by any City
Police officer or other authorized City
officer and impounded in the animal
shelter operated by Cherokee County
Hu:mane Society, Inc. in Jacksonville,
Texas, or any other City approved place
of impoundment. (Ord. of 5-20-80)
Sec. 4.5. Disposal of Pets
After impoundment of any dog or
other common household pet whose:
owner can be identified by the required
license tag, notice shaH be given to such
owner concerning the impoundment of
the dog or pet, and such ownermay claim
the dog or pet within three (3) to five (5)
days after the date of notification. If the
owner does not claim any such dog or pet
within paid period or if no claim is made
for a dog or pet whose ownership is
unknown within three (3) to five (5) days
after impoundment, such dog or pet shall
be disposed of by adoption or euthana-
sia. (Ord. of 5-20-80)
Sec. 4.6. Release from Shelter
Any dog or other common household
pet shall be released from the animal
shelter operated by the City of Rusk and/
or Cherokee County Humane Society,
Inc. in Jacksonville, Texas, upon pay-
ment of the applicable shelter fees. The
shelter fees shall consist of one dollar
and fifty cents ($1.50) per day or fraction
thereof that the dog or pet has been
impounded, plus ten dollars ($10.00) for
the first occasion an owner's dog or other
common household pet is impounded,
twenty-five dollars ($25.00) for the sec-
ond occasion an owner's dog or pet is
impounded within 365 days of the first
impoundment, and forty dollars ($40.00)
for the third and each successive im-
poundment: which occurs within 365
days of the first impoundment. If a fe-
male dog or other common household
pet is impounded while in heat, an addi-
tional five dollars ($5.00) shaH be col-
lected. (Ord. of 12-13-90)
Sec. 4.7. Control Requirements on
School Grounds
The owner of any dog or other com-
mon household pet shall not permit such
dog or pet to go or be upon any public
school grounds when school is in ses-
sion or on any public recreational area
when an organized activity is being
conducted, unless the dog or pet is
controlled by a leash or similar device to
prevent the dog or pet from biting any
person or other animal.. (Ord. of 5-20-

Sec. 4.8. Control of Animals in Heat
Every female dog or other common
household pet in heat shall be confined
within a building orothersufficient enclo-
sure so that such dog or pet cannot come
in contact with another animal except for
planned breeding purposes. (Old. of 5-
20-80)
Sec.. 4.9. Control of Biting Dogs
It shal be unlawful for the owner of
any dog or any other common house-
hold pet which has the propensity to Me
or attack human beings to run loose on
or within such owner's premises in such
a manner as to endanger the safety of
any person lawfully entering such prem-
ises during daylight houre or any author-
ized person entering such premises at
night time for any lawful emergency
purpose. Every owner of a dog or other

LEGAL
Sec. 4.10. Prevention of Public
Nuisances
Every owner of any dog or any other
common household pet shall exercise
proper care and control of such dog or pet
to prevent it from becoming a public nui-
sance. For puiposes of this section
excessiveor untimely barking,molesting
of passers-by, chasing vehicles, attack-
ing other domestic animals, depositing
excretory matter on property other than
that of the owner or damaging property
other than that of the owner by any dog or
pet shall be deemed a public nuicance.

Sec. Sec. 4.11. Humane Treatment
The owner of any dog or other common
household pet shall provide such dog or
pet with humane care and treatment and
specificaUy with sufficient food and water,
proper shelter and veterinary care when
needed to prevent inhumane suffering by
such dog or peL Unwanted animals may
be given to the animal shelter operated by
the Cherokee County Humane Society,
Inc., in Jacksonville, Texas, at no cost to
the owner. (Ord. of 5-20-80)
Sec. 4.12. Impoundment of Sick
and Injured Animals
Whenever any City Police officer or
other authorized City officer shall encoun-
ter an injured orsick animal whose owner-
ship cannot be readily determined, such
officer may cause said animal to be im-
pounded at the animal Shelter operated
by the Cherokee County Humane Soci-
ety, Inc. in Jacksonville, Texas. The Ani-
mal shelter may cause such animal to be
treated and charge the expenses of such
treatment against the owner or other per-
son claiming such animal or may have the
animaldestroyed by humane means. (Ord.
of 5-20-80)
Sec. 4.13. Reporting of Animal
Bites
When any dog or other common house-
hold pet subject to rabies has bitten or
attacked any person or when any dog or
other common household pet is suspected
of having rabies, it shall be the duty of any
person having knowledge of such facts to
report same to the City Police Depart-
ment. Such animal shall not be killed but
shall be confined in such manner and for
such period of time as the City Health
Officer shall direct. No person shall re-
lease from confinement any such animal
or remove any such animal from its place
of confinement toanother place without
the consent of the City Health Officer. The
confinement of the animal shall be at the
expense of its owner, and the City Health
Officer shaH be empowered to his discre-
tion to order impoundment and/ or exami-
nation of any such animal for the puipose
of determining whether it may have ra-
bies. No person shall refuse to surrender
any animal for quarantine when demand
is made therefore by the City Health Offi-
cer. If the animal dies or is killed, a labo-
ratory examination of the head of such
animal shall be made. No person shall
refuse or fail to comply with theprovisions
of this section or with the order or direc-
tive of the City Health Officer relating to
the requirements of this section. (Ord. of

Sec. 4.14. Right of Enforcement
Any officer of the City Police Depart-
ment, or any other City officer or em-
ployee designated or authorized for this
puipose, shall have the right to enforce
any of th:e provisions of this article. Any
such officer or employee shall be author-'
ized to enter upon private property for the
purpose of enforcing this article. No
person shall conceal any dog or other
common household pet or otherwise
interfere with the proper enforcement of

' Inc. (LCTX) filed an application on Janu-
ary 8,1992 with the Public Utility Com-
mission of Texas seeking approval to
implement rates, terms and conditions
for a new optional service offering called
Enhanced Custom Calling Features. The
service wiH initially be offered in the
exchanges of Apple Springs, Central,
Conroe, Etoile, FuHer Springs, Hudson,
Lake Conroe, Lulkin, Montgomery, Rfv-
eibrook,Walden and Wells. Customers
in Alto, Cut-N-Shoot, DboH and Granger-
land wiH be notified when these services
become available.
Business and residence customers may
subscribe to these new optional central
office based enhanced features in addi-
tion to those already offered by LCTX.
Proposed monthly rates for each en-
hanced feature are as follows:

Alto buys video
camera for P.D.
Meeting in special session, Jan.
16, the Alto City Council voted on
the purchase of a video camera to be
used by the Alto Police Department.
After lengthy discussion during
executive session, council voted three
to two in favor of the purchase. Vot-
ing yes, were Si Williams, Verna Lee
Arnold and Howard Tyer. Voting
against the purchase were Dixie
Dolcater and Terry Black.
In other action, council agreed to
replace officer Benny Mitchell with
Lee Starling as full time officer, on
half pay an d half volunteer salary.
Starling was formerly a volunteer
officer. He will be replaced by an-
other volunteer. Stacy Chambers will
remain as a full time officer on half
pay, half volunteer basis.
Council agreed to change a paid
holiday for city employees from San
Jacinto Day in mid April, to Jan. 20,
Martin Luther King's birthday.
