120 SPECIAL LAWS.
County, Texas, is hereby created as an incorporation for free
school purposes only.
SEC. 2. The said Fivemile Independent School District, hereby
created, shall include the territory now embraced within
Common School District No. 21 Dawson County, as heretofore
created and established by commissioners' court of Dawson
County, which territory is described by metes and bounds as
follows:
Beginning at the N. E. corner of Section No. 39 Block 35 T.
5N, thence W. to the N. W. corner of Section 42 same block
thence S. two miles to S. W. corner Section 43 same block, thence
one mile W. to N. W. corner of Section No. 1 Block 36 T. 4N,
thence south one mile to S. W. corner of said Section No. 1,
thence E. one mile to the S. E. corner of same direction thence S.
one mile to the S. W. corner of Section No. 7 Block 35 T. 4 north.
Thence one mile to the N. E. corner of Section No. 18 same
block, thence S. one-half mile thence east through center of
Section No. 17 and 16 to the east line of Section 16, thence N.
one-half mile with the east line of Section No. 16 to the northeast
corner of said Section No. 16, thence east three miles to the
northeast corner of Section No. 13 same block. Thence north
two miles to the northeast corner of Section No. 1 same block,
thence west two miles to the northeast corner of Section No.
3 same block, thence north two miles to the northeast corner
of Section No. 39 Block No. 35 T 5 north to the place of beginning.
Comprising the following sections: to-wit, Section No.
39-40-42-43-44-45-46 Block 35 T 5N Section No. 1 Block 3 T
4 north, Section No., 1-2-3-4-5-6-7-8-9-10-11-12 and north 1/2
of Section No. 16 and 17 in Block No. 35 T. 4 north containing in
all 14080 acres.
SEC. 3. The management and control of the public free
schools in said Fivemile Independent School District is hereby
vested in a board of trustees, which board shall be composed
of seven persons resident citizens, and qualified voters within
said district who shall be elected and qualify as hereinafter set
forth.
SEC. 4. The board of trustees of said Fivemile Independent
School District shall be and is hereby made a body politic and
corporate in law, and as such shall have power to contract and
be contracted with, to sue and be sued, to plead and be impleaded
in any court of this State of proper jurisdiction, and
may receive any gifts, grants, donations, or devises made to or
for the use of the public free schools of said district.
SEC. 5. Immediately upon the taking effect of this Act, the
county judge of Dawson County shall order an election for the
purposes of electing seven trustees to serve as trustees of said
Fivemile Independent School District, whose terms of office
shall be as follows; The term of office of the seven trustees
chosen at the first election under this Act, shall be divided into
two classes, and the members shall draw the different classes,
the four drawing numbers one, two, three and four shall serve
for one year, or part thereof, that is, until the next succeeding
