SEC. 4. If any part of this Act shall be held to be unconstitutional
or void, it shall not affect the other portions thereof.
SEC. 5. All laws and parts of laws in conflict herewith are to
the extent of such conflict hereby repealed.
SEC. 6. The fact that the present laws relating to navigation district
require excessive bonds from the Chairman of the Navigation
and Canal Commissioners in order to sell bonds, and bonds that may
be excessive exacted of contractors, and do not provide for and
contain adequate condemnation powers for navigation district to
serve the public interests, creates an emergency and imperative public
necessity that the constitutional rule requiring bills: to be read on
three several days be suspended, and said rule is so suspended and
this Act shall take effect and be in force from and after its passage;
and it is so enacted.
[NOTE.-House bill No. 70 passed the House of Representatives by
two-thirds vote, yeas 105, nays 0; and passed the Senate with amendments
by two-thirds vote; yeas 25, nays 1; and the House concurred
in Senate amendments by two-thirds vote of yeas 103, nays 0.]

PIARMAIES.
S. B. No. 44] CHAPTER 32.
An Act amending Article 3093 of the Revised Civil Statutes of the State
of Texas, of 1911, by adding a new section following such article to be
numbered Article 3093a; providing that any qualified elector under the
laws and Constitution who is a Democrat shall be eligible to participate
in Democratic primaries, but, declaring that in no event shall a negro
participate in a Democratic primary in the State of Texas, and declaring
ballots cast by negroes as void. Also by amending Article 3089 of
the Revised Civil Statutes of the State of Texas, of 1911, by adding
thereto a new section to be known as Article 3089a; providing that all
supervisors, judges and clerks of any election shall be qualified voters
of the election precinct in which they are named to serve, and declaring
an emergency.
Be it enacted by the Legislature, of the Stave of Texas:
SECTION 1. Thlat Article 3093 of the Revised Civil Statutes of the
State of Texas, of 1911, be amended by adding thereto a new section
to be known as Article 3093a, to read as follows:
Article 3093a. All qualified voters under the laws and constitution
of the State of Texas who are bona fide members of the Democratic
party, shall be eligible to participate in any Democratic
party primary election, provided such voter complies with all laws
and rules governing party primary elections; however, in no event
shall a negro be eligible to participate in a Democratic party pri-
