assigns, and to his successor hereinafter designated, and to the assigns of said successor
forever; and we do hereby bind ourselves, our heirs, executors, and administrators, to
WARRANT AND FOREVER DEFEND all and singular the said premises unto the said N. S. Johns,
Trustee, and his assigns, and to his successor, against every person whomsoever lawfully
claiming or to claim the same or any part thereof.

installment payment, and the remainder as a credit on the principal of said note; and said
note provides that more than one installment may be paid on any installment paying date.
Said note provides that all past cue interest shall bear interest from its maturity
until paid at the rate of 770 per annum, and for 1070 attorney’s fees, if placed with an
attorney for collection after maturity, or if collected by legal proceedings of any kind;
and we hereby agree, and it is in said note provided, that if we fail to pay any part

executed, and delivered to The Calcasieu Lumber Company, a corporation organized and
existing under the laws of the State of Texas, with its principal office in the City of
Austin, Travis County, Texas, our one certain promissory note, of date October 15, 1938,
for the sum of $890.00, which bears 7% per annum interest from October 15, 1938, and
is payable in installments as follows: one installment of $15.00 shall be paid onthe
15th day of November, 1938, and a like installment shall be paid on the 15th day of each
month thereafter- until it is fully paid and setisired. Each installment payment is
to be applied first to the payment of all unpaid interest accrued at the date of such

That we, Jasper W. Hurt and wife, Nona Francis Hurt, of the County of Travis, in the State
of Texas, for and in consideration of the debt and trust hereinafter mentioned and created

premiums therefor, or if we make default in the payment of any of said installments
maturing on said note, then, at the option of the holder of said note, the same shall
immediately become due and payable, and said holder may, at its election, proceed to

herein given, or by suit, or by other proceedings.
Our said promissory note for the principal sum of $890.00 and this deed of trust
are given at our special instance and request in aid and extension of just and subsisting
