25 acre tract for the Southwest corner of this tract; Thence with the West line of said
25 acre tract N 28-50 E. 255.7 ft, to the place of beginning, containing 5 acres of
land, Variation 10-30 East. Said five acre tract having been surveyed on November 30,
1938, by Metcalfe Engineering Company.
TO HAVE AND TC HOLD the above described premises,together with all and singular the
rights and appurtenances thereto in anywise belonging, unto the said D.D.Harkins and
wife, Gernelle Harkins, their heirs and assigns forever; and we do hereby bind oursel
ves,our heirs,executors and administrators, to warrant and forever defend, all and sin
gular, the said premises unto the said D.D.Harkins and wife, Gernelle Harkins, their
heirs and assigns, against every person whomsoever, lawfully claiming or to clam the
same or any part thereof.

and agree to pay an additional ten per cent.of the amount to be collected, which shall
be added, bear the same rate of interest, and be collected as attorneys fees, and pro
vides that the makers have the right to pay more than one installment on said note at
any timebut no lien is retained to secure the payment of said note; have Granted,Sold
and Conveyed, and by these presents do Grant, Sell and Convey unto the said D.D.Harkins
and wife, Gernelle Harkins, of the County of Travis, State of Texas,all that certain lot
tract or parcel of land, lying and being situated in Travis County/exas,and more parti
cularly described as follows ,to-wit:
Five(5) acres of land, a portion of a 25 acre tract out of the Jesse e, Tannehill Lea-
gue and described by metes and bounds asfollows;
beginning at an iron stake at the Northwest corner of a 25 acres tract which is descri
bed as Second Tract in a deed from Sophia Wendlandt to James R.Weakly recorded in Book
440 Page 198-200, of the Deed Records of Travis County, Texas,said iron stake being
also in the South line of a 35 acre tract described as"First Tract " in the aforesaid
deed; Thence with the North line of said 25 acre tract, being also the south line of
said 35 acre tract, S .60 E. 852 ft. to an iron stake at fence corner for the Northeast
corner of this tract; Thence S. 29-05 W, 255.7 ft. to an iron stake for the Southeast
