ceedings a full and unconditional release of all acts for which
such person had been convicted, and to cancel and remit all punishment
assessed upon such conviction. It is commonly called
the Amnesty Act.
While Attorney General I was requested by the Legislature
for an opinion on the constitutionality of the Act which this
bill repeals. I wrote such an opinion and furnished it to the
Legislature. Upon reasons and principles of law set forth in
the opinion, I concluded that the Act was unconstitutional. I
have had no occasion to change my mind, and I am still of the
opinion that the act which this bill attempts to repeal is violative
of the constitution of this State and never had the force
or effect of law. If the conclusion which I reached in that
opinion was in error, and I do not believe that it was, then Chapter
184, Acts of the 39th Legislature, conferred rights which
are vested and which no repealing act could affect. I, therefore,
approve this bill, believing that the original Act, Chapter
184, Acts 39th Legislature, is unconstitutional, and this bill is
effective to take it off the statute books of this State.

ATTORNEY GENERAL TO ATTEND SALES OF PROPERTY
UNDER DEEDS OF TRUST.
S. B. No. 409.] CHAPTER 243.
An Act to amend Articles 4401 and 4403 of the Revised Civil Statutes of
Texas by providing that the Attorney General shall be authorized and
required to attend sales of property under deeds of trusts, to bid on
and buy in and sell said property.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That Articles 4401 and 4403 of the Revised Civil
Statutes of Texas be and the same are hereby amended so as
hereafter to read as follows:
Article 4401. To attend sales and bid in land.-If any
property shall be sold by virtue of any execution, order or sale
issued upon any judgment in favor of the State or sale by virtue
of any deed of trust-except executions issued upon judgments
in cases of scire facias the agent representing the State by and
with the advice and consent of the Attorney General is hereby
authorized and required to attend such sales and bid on and buy
in for the State said property when it shall be deemed proper
to protect the interest of the State in the collection of such judgment
and debt. His bid shall not exceed the amount necessary
to satisfy said judgment and debt and all costs due thereon.
Article 4403. May Sell Such Property.-The agent of attorney
of the State buying for the State such property at such
sales shall be authorized by and with the advice and consent of
