Developer drops lawsuit against county

Legacy Land and Cattle LLC
dropped its lawsuit in the 216th
District Court against Kendall
County last week, but the rea-
sons why remain unclear.
Dallas attorney for the devel-
oper, William Palmer (no rela-
tion to Kendall County Court-
At-Law Judge Bill Palmer),
could not be reached at
presstime.
The lawsuit was filed a month
after the Kendall County
Commissioners Court denied a
variance request to the density
requirement for the proposed
Circle K Ranch subdivision, at
Highway 46 and Joe Klar Road
with plans to create 1,184 lots on
400 acres.
Palmer argued during an April
meeting that the commissioners
court did not have the authority
to determine lot size, citing sev-
eral court cases and regulations.
But Kendall County Attorney
Don Allee argued the county has
the same governing power as the
city of Boerne has with its
Extraterritorial Jurisdiction
(ETJ), also citing court cases

It’s Election Day!
More than 5,000 Kendall County residents cast their ballots during
early voting for the November general and special elections last week.
More are expected to go to the polls today (Tuesday) for Election
Day. Polls will be open from 7 a.m. to 7 p.m.
There are several heated races that seem to be drawing voters to the
polls.
