Single member district
challenger appeals to
Texas Supreme Court

Although by next month all five
members of the Boerne City Coun-
cil will have been elected from
single-member districts, Mike
Morton continues his courtroom
quest to overturn the creation of
the districts.
Last Thursday, Morton filed an
appeal with the Texas Supreme
Court that, if successful, would
obligate 216th Judicial District
Judge Keith Williams to decide
whether or not the city ordi-
nance creating the single-member
districts violates the Texas Consti-
tution because the matter was not
first put before voters to decide as
an amendment to the city charter.
More than a year ago Williams
dismissed Morton’s request for
a temporary injunction halting
the May 2010 election of coun-
cil members from districts 1, 3
and 5, saying his court does not
have jurisdiction in the matter and
any opinion rendered would be
advisory.

Sentencing delayed in
fraud case involving
resort purchase scheme

Sentencing has been rescheduled
until May 5 for a defendant who
defrauded thousands of dollars
from area businesses last year in
a confidence scheme involving a
fraudulent contract to purchase a
local resort, that made news sev-
eral times last week.
Assistant District Attorney Lucy
Wilke said Lonnie R. Nowlin’s
district court sentencing, originally
scheduled for last week at the
Kendall County Courthouse, was
rescheduled because some neces-
sary paperwork was not ready.
Nowlin, who had a Boerne-based
business known as Nowlin Restivo
LLC, and Virginia Sue Bryant of
Fort Stockton were arrested July
12, 2010 on felony theft charges
related to passing bad checks and
failing to meet contract obliga-

Commissioners contract tor surplus property sales, concrete work

online auctioneer for disposal of
surplus property, Alabama-based
GovDeals.com.
GovDeals replaces TexasBid.
com, a local firm operated by Pre-
cinct 3 Constable Forres Meadows
that did not submit a bid. The
only other bidder was Lone Star
Auctioneers, Inc., a firm based in
the Dallas-Ft. Worth area.
In addition to auctioneer ser-
vices GovDeals will handle all
collections, charging buyers a
10-percent fee and the county
a 2.5-percent fee that will be
deducted from the proceeds of
the sale.
