COURT SUSTAINS DEMURRER OF
INSURANCE MAN ACCUSED
OF GRAFT.
New York June 1. —The demurrer
interposed by Walter R. Gillett to the
suit brought against him by the Mu-
tual Liie Insurance company ot
which he was vice president until he
resigned in March. 1906. has been up-
held by the appellate division of the
supreme court.
Gillette is charged by the company
with having authorized the expendi-
ture for improper purposes ot large
sums of money while acting as gen-
eral manager trustee and vice presi-
dent of the Mutual Life.
The suit is for an accounting of all
such expenditures and for the recov-
ery of the money.
The Mutual's attorneys have 20 days
In which to amend the complaint so
that it will conform to the court's de-
cision.

ST. PAUL MAN NAMED TO
APPRAISE GOTHAM REALTY.
New York. June 1. —Lawson Purdy
president of the tax board has an-
nounced the apnointment of Wm. A.
Somer of St. Paul as an appraiser
of real estate. It will be Mr. Somer’s
duty to introduce in this city a sys-
tem of equalized assessments. There
have been severe criticisms of the
present system of assessing real es-
tate for taxation some of the figures
being purely arbitrary.

SAYS FELL FROM HEAVEN
BELIEVED FOUND.
Rome June 1. —The continued ex-
cavations cn the Palatine hill have re-
rsulted in the discovery ot what is be-
lieved to be the original decorations
of a temple of Asia Minor dating back
to the sixth century B. C. They were
found in the most ancient ot the Pala-
tine temples and include that of Vic-
tory made famous by the worship of
Cybele known in Greek mythology as
the “great mother ot the gods."
The decorations according to the
legend fell from heaven to Pessinus
the ancient city in Asia Minor noted
for the worship of Cybele whence they
were removed to Rome in 204 B. C.

The public schools closed today
with the examination of the pupils of
the lower grades.
The colored people held a mass
meeting last night at the A. M. E.
. church. About out thousand were
. present. Dissatisfaction over arrange-
’ meats for the celebration of June 19
। caused the meeting which ended in
much confusion without definite ac-
tion being taken. The meeting will
be held again tonight.
The official count of the ballots cast
in the recent election for a street com-
missioner shows that Cavanaugh was
elected having received a total vote
of 1190. Campbell was second with
844 votes.
The residence of Colonel W. L.
Thompson was burglaj-ized yesterday
and several articles stolen.
The city school board will have a
regular meeting this afternoon.
Jesse Emerson and family and Mr.
and Mrs. 1. N. Rothwell spent yester-
day on the Salado plcnicing.
There will be a meeting of the stock-
holders of the San Antonio & Aransas
Pass railroad tomorrow.
Will Pitt a young stockman resid
ing near the citv is seriously ill at
the St. Leonard hotel.
. Diamonds have increased in value
ever 100 per cent in the last five years.
They are a better asset than bonds

FIVE DIE IN CUBAN WRECK.
Havana. Cuba June 1. —Five persons
were killed and 11 injured four prob-
ably fatally in a wreck yesterday on
the Cuban Eastern railroad near Guan-
tanamo. One car loaded with work-
men rolled down a steep embankment.
TRAIN KILLS NINE WOMEN.
Corunna. June 1. —A railway train
while being switched here yesterday
ran Into and overturned a vehicle in
which nine women were riding at a
level crossing. All were crushed to
death.

cials from Colombia have arrived in
Havana their object being to watch
the operations of the Colombian revo-
lutionists here.

If Coghlan Had His Life to Live Over
Again He Would Enter the Gov-
ernment Service on the Sea.
New York June 1. —Rear Admiral
Joseph Bulloch Coghlan U. S. N. who
retired today from active service
from the post of commandant of the
New York navy yard declares that it
he had his life to go over again he
would re-enter the United States navy;
that it is the finest organization ot its
kind in the world and that it holds
out greater inducements to the young
men of this country than does the
navy of any other nation. Admiral
Coghlan thinks our navy should be
made bigger and stronger.
In an interview he said: “Peace in
perpetuity about which so much is be
ing said just now. may be possible
but it is not reasonably probable. Be
prepared to whip or be willing to get
whipped is the position in which every
great nation stands today. Let us
keep peace while we have it. The on-
ly way to do this is to keep building
battleships and adding to the numer-
ical strength of the navy.”
Admiral Coghlan thinks the United
States ought to have the most power-
ful navy afloat. He was loud in his
praise of the United States naval
Academy and also of the men who r.e
now enlisting in the navy. Ttycse nine-

treme care as to their physical ill-
ness. Moreover their mental fitness is
on a vich higher plane.
Admiral Coghlan's retirement re-
moves from the service one of the
most picturesque figures in the navy.
He commanded the Raleigh in the
battle of Manila Bay and his subse-
quent recitation at a banquet of the
satirical “Hoch der Kaiser" became an
international episode.
Admiral Coghland was succeeded in
command at the navy yard today by
Rear Admiral Caspar F. Goodrich.
IN POLICE COURT.
Boy Man and Woman Face the Judge
This Morning.
George Schultz a white boy. aged
16 years was arraigned in the police
court this morning on a charge of
vagrancy. According to the police tho
officers have been endeavoring to ap-
prehend the lad for the last two
months. Although caught on two
former occasions he managed to es-
cape.
He was taken in last night while in
the postoffice building. He was seen
to enter and Officers Mock and Fit -
henry closed in on him. About two
months ago. the testimony showed the
boy had almost demolished a chile
stand on Alamo plaza at which time
he was arrested but escaped from the
officer while on the car. Two weeks
later he was again arrested lut es-
caped from the blue coat before they
reached the city hall.
The boy claimed he had been work-
ing for the last two months and had
avoided coming to the city in order to
evade arrest. Last night he testified
he started to go to .the tent show
when he was taken into custody.
W. H. Slake was arraigned and fined
$3 on a charge of failing to have his
chimney swept as required by law.
The fire department was called to the
Elite yesterday afternoon where the
chimney was on fire and the arrest
followed.
Ada Gray pleaded guilty by proxy
to careless and reckless dri/ing and
was fined |5. She was arrested last
evening by the police.
AT ELECTRIC PARK.
Prepaartions have been made at the
Electric Park to handle the usual
large Saturday crowd tonight. The
storm of yesterday did no apprecia-
ble damage. The few’ electric lights
broken have been replaced and tho
park will have its usual brilliant illu-
mination. Every concession will be
running as usual. The park never
gfts muddy. Even after the hardest
sort of rain the parkis perfectly’ dry
and comfortable in thirty minutes.
There is never a dull moment at the
park. The plan is to always ha ve
something doing and this is lived up
to. Torseillo's band will render the
usually delightful concert beginning
at 6 o'clock. A number of popular airs
will be rendered.
FREE LECTURES.
As previously announced Paul Jor-
dan will deliver his famous lecture on
“The Two Salvations of the Bible" at
3 p. m. Sunday and his equally cele-
brated discourse on “The Wages of
Sin” at 8 P- m. tomorrow both lec-
tures to be given upstairs in the hail
at the corner of Crockett and Losoya
streets near the Grand opera house.

POLICE FIND
MURDER TRAIL
GET CLUE TO SUSPECTS WHO ARE
WANTED IN CONNECTION
WITH TRUNK MYSTERY.
New York June 1. —Two ot the
three Armenians who are watted in
connection with the murder ot Father
Kaspar have left the United States
according to Captain McCafferty ot
the detective bureau. He has learned
that John Mooridian and Paul Sarki-
sian had betn seen in a Canadian
town where they have been since last
Saturday two days after the murder
is supposed to have been done.
The body was found in a house in
Welt Thirty-seventh street on last
Sunday. The two men hired the
100 m in which the priest's body was
found in a trunk.
Two men have been detailed from
the detective bureau to go to the Ca-
nadian city and Captain McCafferty
expects to hear today that the Arme-
nians have been arrested.

Victoria Tex. June I.—The Guada-
lupe river is rising rapidly. It has
reached over 13.1 feet above low water
mark. The danger mark is between 15
and 16 feet. Heavy rains have been
falling here. Nearly 200 yards ot the
Southern Pacific track was moved six
feet by the tremendous rains.

Madrid June 1. —The first annivet*
sary of the wedding of the King and
Queen ot Spain was celebrated yes-
terday afternoon in the palace chapel
in thanksgiving for their escape from
the bomb thrown at them while they
were returning from church after the
marriage ceremony.
A memorial mass at the church ot
Bucn Suceso was attended by King
Alfonso and other members of the roy-
al family palace officials ministers
officers of the Madrid garrison and the
regiment which lost some of its men.
During the day the king signed a
decree authorizing the introduction in
the chamber of a bill pensioning the
families of the victims of the bomb
thrower.
