contract to the other party or parties thereto because of or incident
to the facts and circumstances surrounding the execution
thereof or any performance or part performance thereunder.
SEC. 2. The fact that the end of this Special Session of the
legislature is nearing an end and the extreme importance of
the legislation proposed by this act, creates an emergency and
an imperative public necessity that the constitutional rule requiring
bills to be read on three several days in each house be
suspended and said rule is hereby suspended, and that this act
takes effect and be in force from and after its passage, and it is
so enacted.

by a vote of 28 yeas, 0 nays; passed the House, September 19,
1934, by a vote of 109 yeas, 8 nays.]

PROVIDING FOR CESSION OF CERTAIN LANDS IN EL
PASO AND HUDSPETH COUNTIES TO UNITED
STATES BY STATE OF TEXAS.
S. B. No. 25.] CHAPTER 15.
An Act to provide for the cession by the State of Texas to the United
States of America of all right, title and interest which the State of Texas
may have in and to certain lands in El Paso County and Hudspeth
County, comprising the bed and banks of the Rio Grande; retaining
jurisdiction as to certain of such lands in the State of Texas for certain
purposes; reserving the rights of the State of Texas and residents and
citizens thereof to waters of the Rio Grande, and in the use thereof, and
in the access thereto, and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. In order to facilitate the accomplishment of the
project for the recification of the Rio Grande in the El PasoJuarez
Valley, without cost to the State of Texas, and made
possible by the Convention between the United States of America
and the United Mexican States, concluded February 1, 1933,
all right, title and interest of the State of Texas in and to the
bed and banks of the Rio Grande in El Paso County and in
Hudspeth County which may be necessary or expedient in the
construction of the project for the rectification of the channel
of the Rio Grande, as provided for in said Convention, is hereby
ceded unto the United States of America.
Provided, however, that this cession is made upon the express
condition that the State of Texas shall retain concurrent jurisdiction
with the United States of America over every portion of
