CREATING SPECIAL DISTRICT COURT OF UPSHUR AND
SMITH COUNTIES.
S. B. No. 23.] CHAPTER 47.
An Act creating the Special District Court of Upshur County and Smith
County, Texas, prescribing its jurisdiction, limiting its existence, fixing
its terms; providing for the appointment of a Judge thereof, fixing his
compensation, making an appropriation for the same. prescribing his
powers and duties; providing ror the transfer of cases from the Seventh
Judicial District Court to said Special District Court and from said
Special District Court to ithe Court of the Seventh .Jdicial District;
providing for the District Clerks of TlTpshur and Smith Counties and
their successors in office to hbe the Clerks for said Spec'al D'strict Court
in their respective Counties; providing that the District A attorney of
the Seventh Judicial District shall represent the State 'n said Spcial
District Court, and making it the duty cf the County Attorneys of
Upshur and Smith Counties to represent the State without extra compensation
in said Special District Court in their respt(tive Counties
in the absence of the District Attorney or when he is unable for any
reason to do so; providing a seal for said Special District Court: provid:ng
that if any Section of this Act be held unconstitutional or invalid
for any reason, the same shall not impair or affect the remaining
sections or provisions; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. There is hereby created a Ccurt to be held in
Smith County and Upshur County, Texas, to be called the Special
District Court of Smith and Upshur Counties, Texas.
SECTION 2. Said Special District Court of Smith and Upshur
Counties shall have a concurrent jurisdiction with the District
Court of the Seventh Judicial District of all matters and
causes of a civil and criminal nature in Smith and Upshur
Counties over which under the Constitution and General Laws
of the State of Texas the District Court of said Seventh Judicial
District of Texas has original and appellate jurisdiction.
SECTION 3. The Judge of the Seventh Judicial District of
Texas may, in his discretion, either in term time or in vacation,
by order entered upon the minutes of the District Court of
Smith and Upshur Counties, transfer any case or cases that may
at that time be pending in said District Court of that County
to the Special District Court of Smith and Upshur Counties,
created by this Act, and holding sessions in that County, and
said Special District Court shall have the same power and
authority to try and finally dispose of such case or cases so
transferred as the Court possessed from which the same were
transferred; and the Judge of said Special District Court may,
in his discretion, either in term time or in vacation, by order or
orders entered upon the minutes of his court in any of the Counties
for which the said Special District Court is created, transfer
any case or cases pending upon his docket to the District Court
of the Seventh Judicial District holding sessions in the
County and when said case or cases are transferred, the court
to which the transfer is made shall have the same right and
