Burnet county, Texas, filed his petition in tbe office of
the Clerk of the District Court of Burnet county, on
the 28th day of March, 1866. against James m. c. Moss,
complaining that on the 12th day of December, 1865,
the said Moss, for % valuable consideration, made, exe-
cuted and delivered his note to one Jeff Braeieal, for
$130.00 due and payable one day after date, with legal
interest, and that on or about the 14th day of, March,
1866, the said Jeff Braezeal for a valuable considera-
tion and in due course of trade, transferred and en-
dorsed said note to petitioner, and that said note is
due and wholly unpaid, and oath having been madenc-
icordingto law that said Moss secretes htmseif so that
the ordinary process of law cannot bfc served upon
