entitled suit filed in the District Court of said coun-
ty of Harris, her petition alleging herselftobea
resident of said countv and 1 omplaining of Eben-
exer B. Nichols and Susannah Earl, residents of
the county of Galveston in this State, C. W. Back
ley and Mary Jane Hooper residents of the county
of Fort Bend, in said State, John Moore, a resi-
dent of the county of Robertson, in said State, John
W Bergin, Joseph Harris, Ellen Capehart, Rose
Capehirt, Philip Capehart, Archibald Pratt, Albert
Pratt, Mary Pratt and Sarah Pratt, residents of the
county of Harris, aforesaid, Elisabeth Anderson
who is alleged to be absent from the State, James
Eari, Thomas Win Earl , Elizabeth Ann Earl and
Wm Capehart, whose residences are alledged to be
unknown and the children and legal representa-
tives of Alienors Connelley dee'd. whose names and
residences are alledged to be unknown, all of whom
are nude defendants in the aforesaid suit, setting
forth and alleging a complaint of which the follow-
ing is a brief statement, to wit: That petitioner's
father. Thorn, s Earl departed this lile about the
month of July , A. D. i£5t), leaving his last will and
testament, which ha since been duly admitted to
to probate, in which the saidEbeneser B. Nichols,
C- W, Buckley and the testator's son Thomas were
made executors, and bequeathing the landed estate
of the said testator, as set forth in the following
clause of said will to-wit:
"I will and bequeath my landed estate, to be divi-
ded into eight equal parts and equal as to quan-
tity and quality as nearly as possible to be divi-
ded among my children and grand-children as
follows: one lot or pareel to Ellen Jane Hooper,
daughter of Elizabeth Pratt dee'd. one lot or par-
eel to Mary Ann I'ratt, one lot or parcel to Jane
Wells, one lot or parcel to Francis Capehart, one
lot or parcel to my son Thomas, one lot or parcel
to the children of my deceased son James, one lot
or paroel to my infant daughter Susannah."
That said executors were anthorised by said will
to divide said landed estate among said heirs, and
in case said landed estate coqld not Be qeoitably di
vided according to the provisions of said will, then
■aid executors, or any two of them were authorised
by said will to sell said landed estate and divide
the proceeds among said heirs or their legal repre-
sentatives. That said testator died seised and pos-
sessed of four thousand six hundred and five acres
of land, leas three hundred acres, situated on the
south side of BuffUo Bayou, in the said county of
Harris, said land being the same granted to the said
testator by the Mexican Government. That the
said Thomas, one of the executors aforesaid has
sine* deceased, that the other executors aforsaid.

land according tothe provision of said willandthat
from the neglect of duty have forfeited their right
to said trust. That petitioner is the identical Jane
Wells wbo is mentioned as one of the Devisees in
said will that the said defendants Mary Jane Hooper
and Susannah Earl, arethe same persona,who are
mentioned as devisees in said will and that the said
Mary Ann Pratt one of the devisees in said will is
dee'd, and that said Archibald Pratt, Mary Pratt,
Albert Pratt, and faraii Pratt, who are minors and
herein made defendants are the children of the said
dee'd . that the said Francis Capehart, one of the
deviaees in said will is dee'd, and that the said
Ellen Capehart. Rose Capehart, John Capehart,
Phillip Capehart,and William Capehart, who are
miners and herein made de.endants are the chil-
dren of the said dee'd. That the said Thomas Earl
dee'd, one of the devisees in said will, left the said
Elisabeth Ann Earl, and Thomas Wm. Earl, his
children who are minors and herein made defen-
dants. That the children of the said James Earl,
dee'd, who are devisees in said will are the sale

Connellay the latter or whom are dee'd and that said
dee'd, left children whose names and residences are
unknown to petitioner, all of whom are made defen
dints. That it is impossible to make a fair and
eqnitable division of said land among the various
parties entitled thereto that the said minor defen
dants have no other property for support and educa-
tion. That It would be greatly to the benefit of all
parties concerned to have aaid land sold and the
proceeds divided among the parties entitled thereto
aa aforesaid. Petitioner prays that the said Bon.
Court inthe exercise of Its equitable Jurisdiction
appoint some proper and discreet person or persons
to act as trustee or trustees to sell said land on such
terms aa said court may deem proper to prescribe
and that the proceeds of said sale be paid over to
the parties entitled by law to receive the same and
that shares of said proceeds, that inaj be eomingto
said minors be expended under the direction of the
said Court to their education and supported prays
that all the said defendants be cited to appear at the
next term of the said Court and show cause if any
they have, why tbe relief asked for in this peti-
tion may not be granted. And that whereas Jane
Wells, the plaintiff aforesaid has made affidavit ac-
cording to law, that the names and residences of
the children of the AllenoraConnefley dee'd, are
unknown to plaintiff that the residences of the said
Wm. Capehart, one of the minor children of Francis
Oafehart and James Earl, and John Earl.children or
the said James Earl, and who are minors, and Elisa-
beth Ann Earl and Thomaa Wm Earl, children of
Thomas EarMec'd. who aremtoorsaro all unknown
to plaintiff and that the said Elizabeth Anderson is
absentfrom{this State.
This is therefore to command yon to that yon cite
the said children of the said Allenora Connelley
dee'd, and their heirs and legal representatives, the
said Wm. Capehart, James Earl, John Earl, Elisa-
beth Ann Earl, Thomas Wm Earl, and Eliaabeth
Anderson, by making.publication in some news-
paper published in the said county of Harris,for
eight weeks, previous to the return of this process,
te be and appear the Hon. District Court, In and
for the county of Harris aforesaid, at the next term
thereof to beholden at the Court House in the city
of Houston on the 4th Monday of November, 18S7
