1980 decennial census of 20,000 or more which is within the
larger local governmental unit, unless the smaller local
governmental unit assigns its authority to issue bonds prior
to September 1, 1981, or June 1 of 1982 or 1983, based upon
its population, to the larger local governmental unit.

bonds for each calendar year by Internal Revenue Code of

121.2 (005.07.01.002). Business To Be Transacted in Writing.
All business relating to housing bond reservations which is to
be a part of the record in the executive director's office shall
be transacted in writing. Actions taken by the executive
director will be based exclusively on the written record in the
executive director's office.
121.3 (005.07.01.003). Address of Communications. All let.-
ters, documents, and other papers intended for the executive
director relating to housing bond reservations should be ad-
dressed to Housing Bond Reservations, Office of the Execu-
tive Director, Texas Department of Community Affairs, 210
Barton Springs Road, Austin, Texas 78704.
121.4 (005.07.01.004). Documents To Be Typewritten and
Legible. With the exception of lines specified for signatures,
all information and documents relating to housing bond
reservations which are required to be filed with the executive
director must be typewritten. All letters, documents, and
other papers must be clear and legible.
121.5 (005.07.01.005). Receipt of Letters, Documents, and
Other Papers. All letters, documents or other papers relating
to housing bond reservations will be received only between
the hours of 8 a.m. and 5 p.m., and papers will not be received
on Saturdays, Sundays, or holidays established by law for
state employees.
(1) Papers may be delivered by hand to the executive
director's office by personally delivering the papers to the
possession of an employee designated to receive such papers
by the executive director.
(2) Papers delivered by mail will be considered as
received by the executive director's office only upon their
delivery to an employee of the executive director's office
designated to receive such papers.
(3) All papers relating to housing bond reservations
will be stamped with the date of receipt by an employee
authorized to do so by the executive director.
121.6 (005.07.01.006). Acceptance for Filing and Filing Date.
The filing date placed on any letters, documents, o, other
papers relating to housing bond reservations required to be
filed with the executive director will be the date of receipt of
a document which conforms to the statute and to these rules.If any letter, document, or other paper is received and found
not to conform to the statute or to these rules, it will be
returned by United States mail to the sender at the address
designated as the return address on the document itself.
When the document is corrected and received again by the
executive director's office, the filing date will be the date of
receipt of the corrected document.
121.7 (005.07.01.007). Housing Bond Reservations Request.
Upon the effective date of the determination of the state ceil-
ing in each calendar year, an issuer may request reservation
of a portion of the local share by filing a housing bond reser-
vation request, accompanied by a bond purchase contract ex-
ecuted by the issuer and the purchaser of such bonds, with
the executive director in accordance with the provisions of
the statute and of these rules. The reservation request must
be signed by an authorized officer of the issuer and must be
verified before a person having lawful authority to act as no-
tary.
121.8 (005.07.01.008). Limitations on Amount of Local
Share To Be Reserved.
(a) Housing finance corporations filing hous: g bond
reservation requests in 1981 prior to September 1, 1981, or
filing in 1982 or 1983 prior to June 1 of that year, may re-
quest reservation of a portion of the local share not to exceed
a figure determined by multiplying the local population by:
(1) $100, if the local population is 300,000 or greater;
(2) $150, if the local population is 200,000 or more
but less than 300,000;
(3) $200, if the local population is 100,000 or more
but less than 200,000;
(4) $300, if the local population is less than 100,000.
(b) Housing bond reservation requests received by the
executive director prior to the dates specified in subsection
(a) of this section which are for amounts in excess of those
specified in subsection (a) of this section will not be accepted
for filing by the executive director.
(c) In determining the local population of a housing fi-
nance corporation, in instances where two or more overlap-
ping local governmental units have created housing finance
corporations that have the power to issue bonds to provide fi-
nancing for home mortgages, the executive director shall not
include in the total population of the housing finance cor-
poration making the reservation request the population of
any smaller overlapping local governmental unit of a popula-
tion of 20,000 or more which has created such a housing fi-
nance corporation unless the reservation request is accom-
panied by a copy of the minutes of the action of the governing
body of the smaller local government unit by which that
unit's authority to issue housing bonds for the period of the
calendar year prior to the dates specified in subsection (a) of
this section was assigned to the larger local governmental
unit which is making the reservation request.
(d) In each calendar year, after the dates specified in
subsection (a) of this section, the maximum amount of the
reservation request shall not be restricted other than as
otherwise provided by the laws of the State of Texas.
121.9 (005.07.01.009). Housing Bond Reservation Request
Form. The housing bond reservation request filed with the
