surance, State Board of Insurance, Austin.
Summary of Request:
1. What coverages are appropriate for the Joint Un-
derwriting Association to insure against as incidental
coverages within the meaning of Article 21.49-3, In-
surance Code?
2. Does Article 21.49-3, Insurance Code, place a
limit of $300,000 on the amount of protection against
liability which may be afforded by the Joint Underwrit-
ing Association under the category of "incidental
coverages?"
3. Does the $300,000 liability limit on policies as set
forth in Article 21.49-3, Insurance Code, apply to max-
imum aggregate amounts of liability that may be writ-
ten under a Joint Underwriting Association policy, or
* does it apply to the maximum amount that may be writ-
ten to cover one particular claim occurence for a person
or entity?
4. May the State Board of Insurance permit the
Joint Underwriting Association to consider that pre-
miums have been fully earned:
a. when a claim or claims have been paid ag-
gregating the limits of the policy; or
b. when a reserve or reserves have been estab-
lished aggregating the limits of the policy?

Request from George N. Rodriguez, Jr., County At-
torney. El Paso County, El Paso, concerning whether a
court-appointed attorney for an indigent defendant is
entitled to compensation if he is not required to appear
in court.
Summary of Opinion: Under present statutes, a
court-appointed attorney for an indigent defendant at
the trial court level may not be compensated under Ar-
ticle 26.05, Texas Code of Criminal Procedure, if the at-
torney does not appear in court.
