upon to indicate the financial ability of a local com-
munity to support public services to its citizens.

Health and Mental Retardation(b) No grant-in-aid shall be made without ap-
proval of the board.
(c) Grants-in-aid for Fiscal Year 1977shall be
allocated to boards of trustees in accordance with
the following formula: the amount resulting from
the total funds budgeted by a board of trustees as of
the beginning of Fiscal Year (FY) 1976 for state
grant-in-aid, other state funds, and federal funds,
multiplied by 12 percent plus 53 cents times the total
population of the area plus the amount of state
grant-in-aid approved as of the beginning of FY
1976 adjusted to include annual amount for special
project funding.
The above formula is expressed mathematically in
the following terms: (X + Y + Z)A + B(P) -t X, where:
"X" means the amount of state grant-in-aid for FY
1976 budgeted by a board of trustees adjusted to in-
clude the annual amount for special project fund-
ing; "Y" means the total funds budgeted by a board
of trustees as of the beginning of FY 1976 for other
state funds; "Z" means the total funds budgeted by a
board of trustees as of the beginning of FY 1976 for
federal funds; ".4A "means 12 percent; "B" means 53
cents; "P" means total population of the area.
(Grants-in-aid shall be allocated to boards of trustees as
determined by the board.]
(d) Grants-in-aid allocated to boards of trustees
shall be matched by local support in an amount deter-
mined by the department which shall in no case be less
than ten (10) percent nor more than thirty (30) percent
of the amount of grant-in-aid. The amount and kinds of
service and facilities which may be credited to local sup-
port shall be within the discretion of the State Mental

304.01.01
The Governor's Commission on Physical Fitness is pro-
posing to adopt Rules 304.01.01.001 through .006,
which set out the guidelines for meetings, elections, of-
ficers, duties of officers and executive director, funding,
committees, and the procedure for amending the rules
and regulations set out by the commission members.
These rules became effective as emergency rules on
March 4, 1976. The effectiveness of the emergency
rules will expire on July 2, 1976.
Public comments on Proposed Rules 304.01.01.001
through .006 is invited. Persons should submit their
comments in writing to Albert A. Rooker, Executive
Director, Governor's Commission on Physical Fitness,
Room 110, 4200 North Lamar, Austin, Texas 78756.
Comments will be accepted until Friday, March 26,
1976.
The following rules are promulgated under the
authority of Section 44, Article 4413, Vernon's Anno-
tated Texas Statutes.
.001. Meetings. There shall be three (3) regular
meetings of the commission each calendar year, in
January, in May, and in September, or as near these
times as the commission may find practicable. This
schedule may be increased or decreased by commission
majority agreement dependent upon availability of
funds or emergency provisions. Dates, times, and
places shall be scheduled by the chairman upon theVolume 1, Number 22. March 19, 1976
