Highway Commission On
Chorokoo County Claim.
As has been repeatedly ex-
plained through these colums, an
effort has been made to collect |
from the State Highway Com-i
mission a claim for money ex-1
pended on the designated high-
way of this county, which should,
have been borne in part by the
state and Federal government,
the claim amounting to a con-
siderable sum. j
The data was prepared and
submitted to the department, but
was later withdrawn on account
of pending bond propositions.
The matter has again been ag-
itated and as a result a meeting
between the members of the. de-
partment and the Commissioner's
Court of Cherokee county, was
held in Austin, on December 6th.
when the matter was discussed in §
detail and taken under advise- I
ment by the commission.
The following letter, addressed
to the members of the Court, ex- |
plains the position maintained
by the Highway Commission,:
and indicates that it does not j ***
look upon the proposition of re-!
imbursement with any degree of
favor:
Austin, Dec. 9th , 1927
"My attention has been called
to several communications to the
Highway Department relative to
the condition of your highways
and your status as to money
spent, I am advised previous to
the organization of the Highway
Department. I have been re-
quested to write vou specifically
in regard to an application filed
with the Highway Department
for an allotment to match the
money used under your previous
bond issue.
You are respectfully advised
that this Department does not
now and never has recognized
any liability to any county that
had voted bonds and improved
its highways previous to the or-
ganization of the Department,
or which has voted bonds and
improved .its highways at any
• time, where such work was not
done under the supervioion of
the Department.
There are many counties in
Texas that voted bonds and spent
the money in road improvement
prior to the organization of the
Highway Department, and, in al-
most every instance, such roads
were constructed of an inferior
type of material and have long
since been worn out, and it,
would bean expensive policy for!
this Department to undertake to j
rebuild these highways without;
the aid oc the counties they trav-
erse. Therefore, it has been a
fixed policy of the Department
to participate in highway im-i
provement only where the county
is able to furnish its proportion
of the lunds necessary fpr such
improv -merit.
