AMENDMENT OP THE SSN8TITUT10N.
BY THE GOVERNOR OP THE STATE OF TEXAS.
Whereas, by a joint resolution of the last session of the State Le-
gislate, approved March 14, 1848, a certain amendment to the
Constitution of the State is proposed; which joint t evolution is in
the words and figures following, to wit:
- Joint Resolution proposing an 'amendment to the Constitution ol
the State of Texas.
. " Section 1. Be il resolved, by the Legislature of the Slate of
Texas, That the Constitution of the State of Texas be so altered
and amended, that the Judges of the Supreme Court, Judges oi the
District Couits, Attorney-General, District Attorneys, Comptroller I
ol JPublic Accounts, 1 reasurer ol tne faiate, and the Commissioner
of the General Land Office, shall, at the expiration of their respect-
ive terms of office, or in case a vacancy may occur in either of
. hem, by death, resignation, or otherwise, after this amendment
.takes effect, and thereafter, be elected by the qualified electors of the
State in the manner prescribed by law. .
" Sec. 2. Be it further resolved, Tnat the election for District
Judges and District Attorneys shall be confined to their respective
Districts.
"Sec. 3. Be il further resolved, That the Governor cause this re-
solution to be duly puplished in the public prints of the Stale, at
least three months before the next general election for representa-
tives of the State Legislature-"
And whereas, the thirty-seventh section of the General Provis-iohs-of
the Constitution provides as follows:
Section 37. The Legislature, whenever two-thirds of each
'House shall deem it necessar', may propose amendments to this
Constitution ; which proposed amendments shall be duly published
r in the .public prints of the State, at least three months before the
; next general election of Representatives, for the consideration ol
the people ; and it shall be the duty of the several returning officers,
at the next election which shall be thus holden, to open a poll for
and make a return to the Secretary of State, of the names of all
those voting for Representatives: who have voted on such proposed
amendments; and if, thereupon, it shall appear that a majority of
all the citizens ol this btate, voting lor itepresentatives, have voted
in favor of such proposed amendments, and two-thirds of each
. House of the next Legislature shall, after such election, and before
another, ratify the same amendments by yeas and nays, they shall
ae valid to all intents and purposes, as parts of this Constitution:
orovided, that the said proposed amendments shall, at each of the
taid sessions, have been read on three several days, in each House."
.Now, therefore, I, George T. Wood, Governor of the Slate of
- Texas, do, hereby, in pursuance of the requirements of the law and
the Constitution, order and direct that the above recited joint reso-

ration of the people, at least three months previous to the next gene-
ral election to be held throughout this State, on the first Monday

Secretary'of Slate, complete lists of the names of all those voting
for Represeatatives in the Legislature; which lists must show who
Toted for and who voted against the said proposed amendmei.1, as
well as the names of those who did not vote at all upon the question,
as a majority of the whole number of votes cast for Representatives
hroughout the State seems to be contemplated as necessary to an
amendment of the Constitution.
In testimony whereof, I have hereunto set my hand
and caused the great seal of the Stale to be affixed,
at Austin, the second day of April, 15-10, and of the
indepsndeuce of Texas the fourteenth year.

The returns of the election for Commissioner of the
General Land Office, will, in like manner, be made out
separately, sealed up. and transmitted to the Secretary
of State.
And Whereas, by the said act, it is also required that
an election be held in the several precincts of the re-
spective counties of the first and second Congres-
sional Districts, for Representatives in the Congress
of the United States : "

elect one Senator, and make returns to the Chief Jus-
tice of Cass County.
Dist. No. 2 Red River and Lamar will elect
one Senator, and make returns to the Chief Justice of
Red River Comity.
Dist. No. 3. Fannin, Hopkins, and Hunt will
elect one Senator, and make returns to the Chief Jus-
tice of Fan nin County.
Dist. No. 4 Grayson, Cooke, Denton-, Dallas,
Collin, Henderson, Kaufman and Van Zandt will
elect one Senator and make returns to the Chief Jus-
tice of Collin County.
Dist. No. 5 Rusk and Panola will elect one Se-
nator, and make returns to the Chief Justice of Har-
rison County.
Dist. No. 6 Smith, Harrison and Upshur will
elect one Senator, and make returns to the Chief Jus-
tice of Rusk county.
Dist. No. 7 Nacogdoches and Shelby will elect
one Senator, and make returns to the Chief Justice of
Nacogdoches County.

resentative district for which the Senator or Represen-
tative, as the case may be, is to be elected.

AS copies and certificates under the Great Seal are frequently re-
quested to be sent to distant parts of the Slate, without the pay-
ment of fees, notice i hereby given to all whom it may concern thai,
in no'case, can any copy or certificate be given unless the fees charcfld
by the Stale shall accompany the application. By thr aetof the -ICIxh

Whereas, Francis Dietenrh, of said County of Travis, on the I3th
day of July, 1349. filed his petition In the Clerk's office of said Court,
wherein it is alleged that he is the owner of aa undivided half of Cily
Lot No. G in Block Ne. 5G, on Congress Avenue in the City of Aus-
tin, in said County of Travis, together with tho Store House ihercon ;
that the remaining undivided half belongs to the heirs of William S.
Bcaty, dee'd, who are unknown and supposed to rest le in 'he Slate of
Kentucky ; that the aid Bcaty died sometime in :he year 134G; tint
said heirs have no agent or representative known to petitioner ; that
the house on said lot needs considerable repairs, -and is too much dila-
pidated to be suitable to do business in safety; tlitr he, petitioner, is
unwilling to incur the whole cost of repairing id house, and that ho
has been unable to get any one Intciested in said property to join him
in said ropairs. Petitioner prays ftr a partition of said property be-
