wife, residents nndicitizens of Brazoria county in
the State ofTexas, hae filed their petition in the office
of the clerk ofihe district court of said county of Aus

1825, sold to James E B. Austin, a citizen ofTexas,
now deceased, the one half of five leagues of land situ
a ted west of the Brazos River upon Palmetto creek,
two leagues more or lessabove the toxvn of Saa Fe i-
p , in Austin county, which was granted to said James
Cummings on the 9th day of August, 1S24, by the
Mexican Government, with the half of all mills, rights,
uses, improvements and customs partaining to said
five leagues of land. That after the said sale the sa'd
Austin was-married to said Eliza 31. Hdl; that the said
Austin died intestate some tune in the year of 1829,.
leaving one son named Stephen F. Austin, Jr, who
waslus only child and heir at law; that the said Ste-
phen F. Austin, Jr., who was-the sou of said Jame E.
B. Austin and Eliza M. Hill, died intestate in the year
of 1837, (in the month of February) leaving no desctn
dants, and that the said Eliza M. Hill is the heir at law
of said Stephen F Austin, Jr., and as such is thelegal
heirof the undivided half of said five leagues of? land,
Lc., with the heirs at law of the said James Cum-
mings, who died intestate that the heirs at law ot said
James Cummings so far as known to your piUtionere
are Rebecca Portis, wife of David Y. Portis,. residents
of Austin counU, Samuel Anthony Cuinmmgs, wife of
William Cummings, dee'd, a non-ics dent uf the Stae,
and a minor of whom said Rebecca Portis is the guar-
dian, and the heirs of Samuel Cummings, dee'd, whose
