Two Vacancies Filled-Proceedings of
Last Night's Session of the Com-
missioners' Board.
The atmosphere of expectancy that has
iveloped the probable proceedings of the
board of commissioners has been clarified,
and the fears of those who rested for days
'pon the tenterhooks of anxiety have been
dlayedi' The ax did not fall. The commis-
oioners met in executive session last night
id reorganized the department under the
provisions of the charter. It was simply a
re-election of the old members, as no
lianges were made. W. H. Lyne was mada
laptain of hose company No. 1, and l:.
Flannery and L. Harris appointed foremenl.
Rumor had it that the commissioners
would meet at 5 o'clock. and before that
hour the lobby was frequented by inter-
'ted parties and much speculation in-
doulged in as to the result. However, the
lick had announced the hour of 8 when
the commissioners arrived and began their
,liberations. The following are the min-
utes:
Adjourned meeting, Oct. 11, 1899. All mem-
bers present. Mayor Traylor in the chair.
Comniissioner Voren moved that the fol-
lowing appointments made by him be made
to compose the fire department of the city
,,f Dallas:-
H. F. Magee chief, salary $100 per
iimonth; 'headquarters at central fire sta-
;on, corner Main and Harwood streets; to
serve until the first Tuesday in April, 1900.
John W. Ryan, assistant chief at a sal-
atry of $75 per month, with headquarters
t No. 1 hose company house, corner Bry-
aand Hawkins.
T. A. Myerscaptain engine company No..
J. L. Marden, captain chemical company
No. 1'; T. S. Boland, captain engine corn-
a ny'No. 2: John ('lifford, captain engine
company No. 3; T. J. Ramsey, captain

Commissioner Boren moved that, as the
department was two men short, K. Flan-
ne'y and L. Harris be appointed as fire-
men to fill said vacancy. their employment
to begin Nov. 1, 1899.
Commissioner Boren moved that all of th
employes of the fire department except the
chief shall serve in their respective ap-
pointments until the 1st day of June, 1900
and until their successors are appointed
and that they shall receive the same corn
sensation heretofore allowed and fixed by
the city council according to the duties t
be performed by them respectively, except
that until the 1st day of November, 1899,
W. H. Lyne shall receive the pay of a
iireman and thereafter shall receive the
pay of a captain. That the chief shalt as-
yign toathe firemen hereby appointed the
',spective duties to be performed by then

Frank A. Hill, of the Hill Bi-
cycle Works,
IS INDICTED BY THlE GRAND JURY
For Attetupting to Burn His Store
at 133 North Akard Street
Early Last Friday Morning.
Yesterday afternoon the grand jury
returned an indictment against F. A.
Hill, charging him with arson, by at-'
tempting to burn his bicycle store at
131 North Akard street, near Pacific
avenue early last Friday morning.
A warant was immediately issued on
the indictment and placed in the hands
o- Deputy Sheriff A. L. Simpson. At.
about 9 o'clock last night the officer ar-
rested Mr. Hill at his room 139 Emma
street and committed him -to jail.
The Times Herald of last Friday
stated the facts in connection with the
fire as follows:
At 12:50 this morning fire was dis-
covered in the new two-story brick I
building at No. 133 North Akard
street, near the corner of Pacific ave-
nue, occupied as a bicycle store, wall
paper and paint store, drug store and
boarding house, but the flames were:
extinguished before much damage was
done. The fire originated in the bicy-
cle store owned by J. A. Hill, and it ap-
pears was carefully planned by some
enemy of Mr. Hill or the other in-
mates of the house. The blaze was in
its incipiency when Chief Magee and
the department arrived, and was ex-
tinguished by the chemical engine.
Chief Magee, in investigating the fire,'
found that several planks of the floor
had been prized up, and under the
floor was a quantity of paper, kindling,
etc. In the midst of this stuff were
two small boxes, in each of which was
a short candle. The boxes had been
saturated with kerosene. In addition
to this a lot of shavings, paper, etc.,.
was piled up against the partition-
paint and paper house. It was the
evident intention of the incendiary to
light the candles, and leave them to
burn to the bottom of the boxes in)
which they were placed. This would
naturally set the boxes on fire, the
kindling under the floor would catch
from the boxes, then the floor would
catch and it in turn would set fire to
the waste piled up against t'he partition.

The building is owned by B. R.
Parks, and was insured for $4000. Mr.
Hill carried $700 insurance on his bi-
cycle stock and Mrs. Kendrick, wha
occupied the second floor, had $800 in-

A PAINFUL ACCIDENT.
Driver Charles 4 oed Thrown from His
Buggy Yterday.
'Charles Good', who drives the flre chief's
buggy, h-ad quite a painful accident yester-
day morning about 9 o'clock while near t'he
corner of Commerce and Iarwood st-reets,
driving to answer a fire alarm which came
from Commerce and iM'arket streets.
In trying to avoid a collision with the I
chemical engine, Mr. Good made such a
sudden turn that he was thrown from his
seat to the ground by the buggy wheels
striking the street car track.
The horse was going at full speed, but he
managed to 'hold on tthe lines, with- the
result that he was diragged. about fifty feet.

Chief Magee succeeded, in. stopping the
horse and releasing flood, and drove to the
scene of the fire alone.
Mr. Good was exceedingly lucky, for the
chemical engine was Immieiiately behind
the 'buggy and luad it not been for the std-
den veering of .the buggy from its course
a-t the time the accident took place he
would 'have been crushed by the wheels of
the former.
The buggy will probably 'have to be pro-
vided with new wheels. The alarm, of fire
proved to be a false one.

The Dallas lire department has 'come in
for its full share of discusalon of late and
the quarter:'y report of Chief 1. F. Magee,
submitted to the city c u~ncil at the last
meeting, 'furnishes the information desired
by a great many citizens as to the condi-
tio'n of the apparatus. It 'Is as follows:
Dallas, Tex., Jan. 3.-Honorable mayor
and city 'council: According to the revised

Engine company NA. I, M'cKinney and
Leonard--One second' class Ahrens steamer
in ordinary conditIn: a. now boiler has be'n
placed in this steamer, thereby givirg mre
satisfaction. Reel No. I is in a fair eondi-
tion, but bady needs painting. Horses, four,
in good conditioniiose, 800 fdet ordinary,
which Is continually bursting. Harness im
good condition. House 'in fair condition af-
ter being rodded at no expense except ma-
terial, the wik being done by members of
the department
Engine company 'No. 2, Commerce, near
Sakins--One second lass A'hrens steam-
er, in a fair condition. Reel No. 2, in very
good condition outside the need of painting.

good. Hose 800 feet, good. House in ad

repairs are being constantly made.

condition. Hos 800 feet, very poor. House
in afair condition; the roof needs repir-
ing, as it leaks badly. At this station the
repair shop is located, and a vast amount
of work has been done. I would' ask again,
as In 'my annual report, that this shop be
made larger, so that bigger 'work can be
done. I would also col your attention to
the fact that Engieer A. S. Lott does all
this extra work. I 'would recommend that
he he allowed extra compesation, as 'he
saves the city 'hundreds of dollars.
Engne company No. 4, Commerce, near
c'ty hIll-One extra first-class Ahrens
steamer, in good conditio. Reel No. 4, in
good condition. lborses 'four, good. Harness
in good o0ad'ion. Hose, 13.0) feet goad anill
300 feet ordminary. House in good condition.
Hose company No. 1, T1ryn, near Haw-
kins-Hose reel No. 1, fair condition, needs
painting badly. Horses, seven, in good con-
rlition. Harness in good coidli on. Hoe. 400
feet good and 400 feet ordinary. One seven-
ty-live-foot 'aerial ladder in a. faii condi-
ton rThere are no men attached to this

Would recommend that this be sold o
transferred to the street cleaning depart-
ment and that a light one-hors wagon
be bought in Its place. House in fair con-
ition. The frame storage houses built for
hay, oats. 'coal, etc., need repairing badly,
as they leak.

Central fire station, Main 'and Harwood-
One double' C-gallon chemical, in fair 'con-
d'ton; this .has been in service 'for seven
years. (One chief's buggy, in bad condition
new wheels are badly needed. Last, but not
least, truck No. 2. The truck and' ladders
are in a bad and dangerous condition, as
hasibeen rey'iutisly reported and ds'eus'sed
'so throrouighly' that your hIo'acoial,.l bodt,
well knows the need of a new trck.

I wuld especially call your attention to
the fact that all the apparatus' in ths de-
partment need's painting very badly: also,
with the exception of the central station,
which was painted this last fall by' mem-
hers of this department, 'they need' painting
to preserve' them.
Reg,'r-Cng recommendations as to houses
and changes In property, I would' respect-
fully refer you to my annual report.
I would agaon request the purchase imie-
diately of at 'least 480) feet oif hose on the
same grounds as fully stated in my annual

the purchase of fire hats for 'the members
of the department. I would respectfully ask

The Dallas Charter Delegation
Returned this Morning.
City Attorney Ellison, Chief of Po-
lice Cornwell, Secretary Moore, Fire
Chief Magee, Aldermen Barry and Cal-
lahan and Messrs. Sanger, Farnsworth,
,Hall et al returned' from Austin this
morning, where they went to discuss
tle Dallas city charter before the
house committee on cities and towns of
the Texas legislature The consensus
of opinion amongst the returned dele-
gation is that the amendments in their
present shape will be favorably consid-
ered by the committee on next Thurs-
day and that they will pass the legis-
lature with but little opposition. The
representatives froS1 Dallas county are
said to be almost unanimously in favor
of the metropolitan police and fire sys-
tems, as contemplated by the new
amendments. The Austin charter pass-
ed yesterday with these provisos, and
it is regarded as almost a certainty
that the new Dallas charter will place
the fire and police departments in the
control of commissioners to be ap-
pointed by the governor.
City Attorney Ellison will return to
Austin next Tuesday to look after the
city court bill and the charter amend.
