In the handicap yesterday Closer,
■on of Abe Frank, established him

took the measure of the speedy Lady
Ranking, the McLemore filly. Much
speculation that hung around the pos-
sibilities of these two good two-year-
olds has been the. theme of comment
\ 4n all the places where the horse-
men congregate and It was a hutch
divided question
The filly hud many supporters as
was evinced by her price at the track
and those who liked the daughter of
Leonid were confident that she would
he returned the winner. They pinned
their claims to the fact that she con-
ceded much weight to the Newman
colt when she last hooked up with
him on Dec. 2. They thought that
the difference In weights yesterday
Would assure her the chance she
needed to heat Closer and the de-
cisive win of the son of Abe Frank
settles the question for he never left
the result In doubt.
Closer broke flying, made every
post a winning one and never had to
be extended to beat his field. Had
the result been between the colt and
Rady Rankin it is a question of which
would have had the biggest field of
supporters for both arc noted for
their gamencss and those who waited
for the event were in hopes that the
fitly would he a contender.
The race of Vanir the big hand-
some chestnut, son of Holltalre, es-
tablishes the fact that the Grcfer barn
has a good racing tool In the colt and
over a distance route he will take a
lot of beating before the meeting la
over. FI (iron ee Cohorts ran a good
race and will be hard to beat In
cheaper company. The filly Is out-
classed with the horses she met yes-
terday and had scant chance.
The stable of J. W. Levy, the Kl
Faso grocer, put one over yesterday I

beat Dactyl)*, a well liked favorite by
a half length for the honors it) the |
second race. The first event went to
- Raquette. Mandadero, the favorite,
was never a contender.
Kootenay succeeded to the third
event thVough the bad ride on An-
gelus. The Sandringham gelding was
on the outside and moving up on the
lenders when for some unknown rea-
son Molesworth took him over to the
rail and then failed to get through
In time to heat the flying Kootenay.
Chuntlclor well up all the way In
the filth race, assumed command at
the turn and won by a nose from
Robert who finished strong. Error
had good early foot but tired when the
real racing began. Keepmovlng well
played was n^ver dangerous.
The last event found Salvage a well
played favorite unable to run back to
his Inst race. Ilex far hack to the
stretch outgamed Prince Winter in the
final hundred yards.
I he day was ideal and the crowd
one of the best that has been seen
on Friday since the meeting opened.
As it was ladies' day and the weather

DEMOCRATIC CONTENTION-
UPHELD BY COURT.

Santa Fe, N. M., Dec. 29.—The last
obstaclo delaying the completion of
the canvass of the vote cast on elec-
tion day, November 7,-was removed
this forenoon, when Judge C. J. Rob-
erts of the territorial supreme court
handed down an opinion which up-
held the principal contention of tho
Democrats that the election judges
and clerks of Clayton should be or-
dered to sign the election returns.
The Democratic judges and clerks
had already signed and the signature
of only one of three Republican pre-
cinct judges is needed to enable the
canvassing hoard to complete the
count. As one of the recalcitrant
Judges happens to be In the capital,
the certificate for President Taft will
be ready by tomorrow evening, tho
engrossing of the thousand names of
candidates with the vote for each, be-
ing a time robbing task. The certi-
ficate will be taken to Washington.

son of Albuquerque, who expect to
leave tomorrow evening and to pre-
sent the certificate to President Tart
on next Wednesday, who, presumably,
will issue the proclamation admitting
New Mexico, forthwith. The decision

DECLARED INSANE

Seattle, Wash.. Dec. 29.—Ex-Gov-
ernor Malcolm R. Patterson of Ten-
nessee departed for his home tonight
by way of Chicago, taking with him
his 23-year-old son, Malcolm C. Pat-
terson, who, after shooting R. T. Seal
at Port Orchard, on Dec. 7, waa ex-
amined by a commission of experts
and pronounced insane from long
continued use of liquor. The young
man, who was turned over to tha
custody of his father, will be placed
in the Tenessee state asylum.
