Probation sentence in
man’s accidental death

A 20-year-old Gilmer man
was placed on 10 years “de-
ferred adjudication” proba-
tion Friday after pleading
guilty to manslaughter in con-
nection with a Dec. 30 pickup
crash that killed his 18-year-
old male passenger.
Benjamin Lee Powers was
sentenced by 115th District
Judge Lauren Parish, accord-
ing to a statement released
Monday by Upshur County
District Attorney Billy Byrd’s
office. Neither drugs nor
alcohol were involved in the
incident, which was basically
a “young man in a rage driving
recklessly,” Byrd said.
Powers, 19 at the time of
the accident, was originally
charged with felony crimi-
nally negligent homicide in
the death of Caderrius De-
shaw Green of Gilmer. But
the charge was upgraded
to manslaughter “based on
evidence the investigation
showed, ” Byrd said at the time
Powers was indicted on the
manslaughter charge several
months ago.
“Deferred adjudication”
means no final conviction
will appear on Powers’ record
if he successfully completes
probation. However, when
such probation is revoked, the
defendant can be sentenced
to the maximum term for the
offense, which is 20 years in
prison for manslaughter.
In that event, Powers would
have to serve 10 years before
becoming eligible for parole,
because the pickup was de-
termined to be a “deadly
weapon,” Byrd said.
Green died when a west-
bound Ford F-250 pickup
driven by Powers overturned
several times on FM 49 about
one mile west of Gilmer, eject-
ing Green from the vehicle be-
fore it rolled over him, authori-
ties said. Powers and another
passenger, 17-year-old Cody
Garcia of Gilmer, escaped
injury in the nighttime acci-
dent, said investigating Texas
Department of Public Safety
Trooper Brandon Love.
The indictment alleged
Powers was “passing a motor
vehicle in a no-passing zone on
the crest of a hill” and exceed-
ingthe speed limit, causingthe
pickup to leave the roadway,
said Byrd.
Byrd told The Mirror Mon-
day that Powers had been
driving slowly, and that the
defendant became enraged
when another vehicle safely
and legally passed him. The
accident occurred after Pow-
ers accelerated and attempted
to pass that vehicle, Byrd
said.
When the truck ran off the
road, Powers overcorrected
and the vehicle “fishtailed,”
ejecting Green, Byrd said.
The truck came to rest on its
top, the prosecutor said. Pet.

THIS PAVILION-TYPE BUILDING, called a pergola, is near-
ing completion at the vacant lot next to the Upshur County
Library on Hwy. 154 W. (Tyler St.) in Gilmer. It on the site of
the old Library Annex, which burned about 10 years ago.
The dictionary defines pergola as “an arbor-type building
with a lattice roof.” When the building was approved by the
Gilmer City Council several months ago, they were told that
it is similar to a pavilion, but could be moved if necessary.
It will be used for outdoor programs, weather permitting.
Construction was financed by the Friends of the Library.

potato supper
The Gilmer High School
Stars Drill Team will hold a
potato supper fundraiser Fri-
day, Nov. 9, before the Buckeye-
Kilgore football game.
The dinner will be held in
the high school cafeteria, with
a menu of baked potato, salad,
cookies and a drink. Tickets
for those over 12 are $6; 3-12,
$3; and under 3, free.
Tickets may be purchased
in advance from any drill team
member or at the door.
Dulcimer Club
to meet Saturday
The Gilmer Dulcimer Play-
ers and More will be meeting
this Saturday, Nov. 10, from
9 a.m. until noon at the First
Baptist Church Annex on the
southeast corner of Buffalo
and Trinity.
A beginners’ class will
begin at 9 a.m. with a not-so-
beginner players meeting in
another area. Everyone will
come together about 10 a.m.
to practice together. The group
will play until about noon.
The group welcomes every-
one who would like to come to
participate or just to listen.
Reindeer Run entry
forms available
The Alpha Nu Epsilon chap-
ter of Beta Sigma Phi will hold
its inaugural Reindeer Run on
Saturday, Dec. 1, beginning
at 7:30 a.m. at Gilmer High
School.
Entry forms may be picked
up at the Gilmer Area Cham-
ber of Commerce.
A pre-registration fee of
$20 (adult) or $15 (ages 12 and
under) is due by Nov. 10. Late
registration fee (after Nov.
10) is $25.
The run will consist of
a 1-Mile Fun Run and a 5K
race.
Prizes will be awarded for
1st, 2nd, and 3rd places for male
and female in the 5K.
