Reiugio County, Greeting:
You are hereby commanded to sum-
mon Chichester Chaplin, and the un-
Known wife of said Chichester Chaplin
and the unknown heirs and the un-
known devisees of each the said Chi-
chester chaolin and his said unknown
wife, and Charles H. Hangon, and the
unknown wife of said Charles H. Han-
gon, ami the unknown, heirs and the
unknown devisees of each the said
Charles II. Haugen and his 3aid an
known wife, and Olivia M. O. Larkin,
J and the unknown husband of said
Olivia M. c. Larkin, and the unknown
heirs and the unknown devisees of
each the said Olivia M. c. Larkin and
her said unknown husband, and Oli-
via M. c. Fowler and the unknown
husband of said Olivia M. c. Fowler,
and the unknown heirs and the un-
known devisees of each the said Oli-
via m, c, Fowler and her said unknown
husband, and Wilson W. Fowler, and
the unknown wife of said WilsohXW.

each of said parties hereinabove de-
signated, by making publication of this
citation once in each week for four
successive weeks, and for eight suc-
cessive weeks previous to the return
day hereof, in some newspaper pub-
liseed in your county, if there be a
newspaper published therein, but if
not, then in any newspaper published
in the 24th Judicial District; but if
there be no newspaper published in
said Judicial District, then in a news-
paper published in the nearest Dis-
trict to said 24th Judicial District, to
appear at the next regular term of
the district court of Refugio county,
Texas, to he holden at the court house
thereof, in the town of Refugio, on the i
Ninth Monday after the second Mon-1
day in February, A. D. 1903. the same |
being the 13th day of April, A. D,
1903, then and there to answer a peti- *
tion filed in said court on the 21st day
of November, A, D. 1002, in a suit,
numbered on the docket of said court
No; 508, wherein J. oolweil Dilworth is
plaintiff, and the parties whom you
are directed to summon and above
named ure the defendants, and a brief
statement of the cause of action al-
leged in said petition being as fol-
lows:—
Plaintiff alleges that about Sypi, j,
1902, be was the lawful owner and
in peaceable possession thereof, but
the defendants unlawfully ent ered up-
on and ousted plaintiff from that tract
of land in Refugio county of about
1280 acres which were on July 1, 1884,
patented to Chichester Chaplin by
patent No. 378 In Volume 9 and fully
described in said petition.
Plaintiff further avers that the de-
fendants are asserting ad\ erse claims
to said land, which are wholly with-
out merit, and that the title of plain-
tiff is that Thomas Scott, the original
grantee of the certificate, sold the
same while personal property, th Chi-
chester C haplin, and that the latter
sold it fc®. Daniel Q . Osborn, who about
December 9, 1850, caused the certifi-
cate to be located, upon the above
land, and the field notes to be return-
ed to the General Land Office.
That Osborn sold a one half interest
in said location to John t. Allen, and
the other half interest to Of. c. Osborn,
and that each said Alien and said G. o.
Osborn convbyod their interests to
Charlotte D. Guiletfc, the wife of New-
ton c. Gullett, and that both said char-
lotte D, Gullett and Low ion c, o idle it
did die intestate and plaintiff' has all
the title of ail the heirs at iaw of both
Of them.
That Daniel e, Osborn and his suc-
cessors in estate did at all times after
its location assert title to said land,
and that plaintiff and those, whose es-
tate he has, have had adverse posses-
sion of said land for twenty-six years,
and plaintiff , pleads the statute of lim -
tation of three, five and ten years to
said land.
That the adverse claim asserted by
the defendants, Chichester Chaplin,
lm unknown w.8o, the unknown heirs
arid devisees of each the said Cniches-
ter Chaplin and said unknown wife,
and fee unknown claimants under
them, arises from the fact that about
July 1, 1884, the State of Texas, issued
a patent to said land to said Chiches-
ter Chaplin, but that the latter had
sold the certificate to Daniei c. Os-
born, whose title plaintiff has, and
thus this claim is without validity.
That the adverse claims asserted by
the defendants Charles H. Hangon,
his unknown v/ife, and the unknown
heirs and devisees of each, said Han-
gon and his unknown wife, and the
urfknown claimants under each of
them, arises from the fact that on
November 27, 1891, there was filed for
record in the Deed Registry of Refu-
.gi©' county what purports to be a pow-
er of attorney from C hichester cnap-
lin to one, F. Brichha, and a deed irom
said Chichester ohaplin, by suid at-
torney In fact, to Charles H. Hangon,
transferring said land certificate,
