alfiest criminal lawyers of Texas,
and for many years a resident of
Goliad county, died at his ranch
near San Antonio last Thursday

thorities and proceed to bring
about orgies in savagery like
that enacted at Stateboro are
the laws worst enemies. Others
violate the law. These kill the
law. Two bodies can not occupy
the same space at the same time.
No community can have the mob
and the law at the same time.
One or the other must-go. The
question is simply which one
shall go. If the law must give
place to the will and fury, of the
mob, then we should quit calling
it government and call it. anar-
chy. That is what it is.”

was one of-the most pigJmineut
men in Southwest Texas. He
was born in Louisville, Ky\, in
1838. He came to Texas When
he was 10 years old and settled
near Goliad. Among the first
work that he performed was tak-
ing rocks out of a rock quarry
at Goliad. He educated himself,
and went to school in Bastrop
with Joseph D. Sayers. He read
law early, and while clerk ot the
District court at New Braunfels
obtained his license to practice.
In the Civil War lie was a mem-
ber of Silbley’s brigade and par-
ticipated- in the Louisiana and
New Mexico campaigns, He was
at first adjutant in the Fourth
regiment of this brigade and
later was a captain. On Sept. 3,
1861, lie married Miss Mary Mil*-
lett, sister to Capt. Alonzo Mil-
lett, in Guadalupe county. After
the war he was elected district
attorney for the district repre-
sented by Goliad, Victoria, Refu-
gio and adjoining counties. He
was in some of the most noted
criminal and land cases of the
South. In the celebrated Dr.

guest of her friend, Miss Zilla

gio, made a business trip to

MISTAKE CORRECTED.
The last issue of the Goliad
Guard had a long editorial on
the prospects of the M. K.&T.
railroad building through Goliad
and Refugio counties on its way
to deep water at Aransas Pass.
It also refers to Refugio’s pro-
posed Frisco line by saying .
A prominent citizen of Refugio,
and one down among the first and
largest subscribers to the Lott Exten-
sion bonu3 , was in Goliad recently,
and from him we learned that by wire
they were to know on a certain day,
now past, the result of a meeting in
St. Louis cf railroad officials, and
whether Refugio would get her rail-
road or not. That meeting was held
and was no other than a meeting of
Frisco and Sap officials, figuring on
the aforesaid deal, and from reliable
authority we learn that that wire
message passed through Goliad and
announced that the deal was eonsu-
mated. But it is an ill wind that blows
no one good, and Refugio may yet
profit by such a step, for with a direct
north and south line, deep water at
one end and northern markets at the
other, how much better off would
she be ? With the M. K. & T.. there
would be an attraction for a Sinton
extension.”
In reference to the above, we
are glad to say that Col. Davis
information while coming from a
reliable source, was a mistake1
No doubt, by this - time, the edi-
tor of the Guard is satisfied that
Refugio is to have a railroad
and that work has actually been
started on same. to the M.
K. & T., we believe that when
deep water is an assured fact at
Aransas Pass, there will be a
good chance for Goliad and Re-
fugio to get this road, but at the
present time, we can not see
much hope. We can onlv say
that when the time comes to act,
Refugio will not shirk her duty
and will be ready and willing to
do her part.

Refugio County, Texas, on Satur-
day August 27, 1904, at 10

Much has been said about the
Brownsville -country, but no
where in the State of 'Texas can
there be found a better climate,

court quashed the famous indict-
ments, concluding “against the
peace and dignity of the Statute.”
Col. Lane was in the celebra-
ted $100,000 O’Connor forgery
ease, which he successfully defen-
ded for Mr. Dennis O’Connor.
He also made successful defenses
in the murder eases growing out
of the noted Taylor-Sutton feud.
In 1879 he represented Goliad,
Victoria and adjoining counties
in the State Senate. He after
ward nu>ved to San Antonio,
where he resided up to the time
of his death. During the term
of ’Hon. Joseph D. Sayers as
Governor, he was appointed
judge of the Thirty-sixth Judi-
cial district, an office he held for
about nine months. Col. Lane
was a gentleman of the old
school—a man of splendid pres-
ence, reserved manner and digni-
fied bearing, but courteous at
all times.”

did not connect Goliad with Re-
