I he meeting was called to
order at 7:05 by Mayor
McDowell
Motion carried to approve
the minutes of past meetings by
waiver of reading
The council voted to up
prove payment of current bills
presented
South Rains Water Supply
Corp board members were
present to discuss the new
water rates Bob Russell,
spokesman for South Rains,
told why the board had voted to
reject the new water rates as
being in violation of their con
tract because their contract
states that no rate increases
shall he passed on to them for
capital improvements to the
water system
I he city's engineer and the
city’s attorney both tried to ex
plain to Mr Russell and other
members that replacing the
worn out line and pumps and
fixing the electrical system,
clarifier and chlorination
system were not capital im-
provements hut were necessary
maintenance. Capital im
provements would involve ex-
panding or adding to the water
plant for greater capacity
The council voted to meet
with the South Rains Board to
try to work out the new rates
before hilling them tor the new
rates as of June 1. 1986
The council then voted to
move Agenda Item No. 11 up
to No. 4 due to the attorney
having a meeting to go to. The
council voted to go into ex-
ecutive session to discuss legal
aspects concerning Ordinance
3-1985 concerning the section
on Public Nuisance
After coming out of ex
ecutive session, the council
voted to have the attorney pro-
ceed as the law requires for the
removal of the old house at 423
N Ravine St and for the lot to
he cleaned up, as per Or-
dinance 3-1985
The council discussed the
recent Ordinance 4-1986
which raised the water and
sewer rates to pay for the water
improvements with the city’s
financial advisor, Ed Moore,
who drew up the rate schedule
The council voted to affirm the
rates as are and to let the
school know of their decision
immediately.
Kindle, Stone ft. Associates'
engineer Joe Harle then
discussed right-of-way
easements for the new
transmission line. The council
had previously voted to have
the line put on highway right-
of-way along Hwy 35. Coun-
cilman Doycc Knight brought
to the attention of the council
that in the event that the
Highway Department decides
to widen Hwy 35, which is
badly needed at this time, the
city would have to move the
line at a cost of a half a million
dollars or more.
The council voted to have
the engineer proceed with ac-
quiring casements to have the
line put on private property in
stead of on highway right-of-
way.
Virgil McEnturff was pre-
sent to request the city give
him back his easement on a
sewer line on his property at
Emory Auto Supply since this
is a dead line and no longer in
list- The council voted to give
the easement hack
Joyce Hare was present to
discuss water and sewer lines
for a small trailer park she is
putting in on FM 2795 West
The council gave her the
necessary information concer-
ning placement of rnetcr and
lines, erst figures and told her
we would try to find the sewer
easement lines already on her
property. The council voted to
enter into contract with Mrs
Hare concerning specifications
and payment of bills
Marshall Bishop and Rick
Ellison were present to discuss
the water and sewer rates at the
Emory Trailer Park they own
They wanted to know, if they
were to drill a well for a water
source could they still have
sewer service Alter much
discussion, the council told
them there is an ordinance
which states that if a customer
of »he < ity of Emory has one
service, they must have all ser-
vices available to them by the
city; therefore you cannot have
water without sewer, or sewer
without water

discuss die water drainage pro-
blem m the Katy Addition
After much discussion, the
council read them the or-
dinance pertaining to culverts,
which are required by
developers or property
owners, and told them to have
the Municipal Judge act to en-
force this ordinance. The
drainage problem in the Katy
Addition stems from numerous
houses which do »<*t have
culverts in front of their
houses, so when it rains, the
water has no where to go but
into yards, causing water to
hack up into some of the homes
and severe erosion
The council nominated
Rubye McKeown to serve on
the Board of Directors of East
Texas Council of Govern-
ments She was elected unani-
mously to serve in this capaci-
ty, replacing former council-
person Mildred Garrett
Charles Dickerson. Public
Works Director, reported on
work done from April 8 thru
May 12 as follows; 21 new
connections, 10 disconnects
for moving. 13 disconnect for
no pay. 1 disconnect for no
deposit. 17 meter change-outs,
3 water leaks fixed. 4 water
taps made, 8 water reconnects,
water connected to new jail, 2
broken meters replaced,
culvert and ditch fixed at Mrs
Hayes on N. Ravine St., 2
sewer taps made. 30 sewer
stoppages fixed, one manhole
pul in. cleaned sewer plant,
and 4 tons of asphalt put in
holes in roads.
After the City's engineer
and financial advisor met with
the city council, they then went
out to the school to meet with
them concerning the water
rates. The school is debating
whether to get their water for
the new elementary school
from the City of Emory or
from South Rains, due to South
Rains offering a lower rate.
The City of Emory, the
engineers, the school board
and South Rams arc to meet
Monday night. May 19th, to
try to work all this out If a
compromise is not reached to
satisfaction of all. the whole
water project could have to be
scrapped and the city and all of
its customers will tv hark
where they started - with a
water system in had need of
repair and out of water off and
on all summer.

The minutes of the April 8th
regular hoard meeting and the
May 5th special board meeting
were approved
Al Hays reported that con
struction of the administration
building should be completed
in about three to four weeks
He stated that according to the
contracted number of Jays re
quired for completion of the
administration building, the
project should have been com-
pleted as of May 2nd After
considerable discussion, the
board agreed that any waiver
of the $200 per day penalty for
non-completion must be con
sidered cautiously
Mr Hays then reported on
the new elementary school
construction He statekl that the
foundation to the kitchen area
will soon he poured He also
reported that the steel work is
nearing completion and
brickwork should begin within
two weeks
The chair invited comments
from guests present, none were
made

of Kilgore in the amount of
$2,000 for the air conditioning

have only city residents pay for
the bonds He explained that
the city adopted the current
rate structure as a measure for
water conservation

board regarding the water rate
structure and the water bond
project He suggested the
school board consider another
joint meeting with the Emory
City Council to discuss the
issue
Mr Gideon addressed the
hoard regarding drilling a
water well After a lengthy
discussion, motion carried to
authorize Mr Gideon to con
tract for a test water well
The board then voted to ap
point Mr Jim Bernard as text
