Miss Texas Cosmetology pictured above is Miss Lynda
Pruett formerly of Bartlett. She was presented this
trophy and a dozen red roses in Dallas after winning
the title in competition with 27 other beauties. She
attended banquets parties contests and appeared on
TV. She will return next year to crown the 1963 queen.
She is the granddaughter of Mrs. Pearl Pruett of Da-
villa.

Explained
The death of an intestate
person (one who has made no
will) may give rise to many
problems regarding distribution
of his separate estate. In the
preceding column we investigat-
ed the manner of dividing the
community estate upon the
death of a husband or wife.
Now we shall see that where
separate property is involved a
completely different set of rules
applies in determining heirship
and apportioning the estate
among the rightful claimants.
It may be well to recall that
the separate estate of a husband
or wife includes property own-
ed by either before marriage
and that which is acquired af-
ter marriage by gift or inheri-
tance. Any other property ac
quired after marriage is pre-
sumed by law to be community
property until the contrary is
clearly proved.
Now . here is a general idea
as to how your separate proper-
ty will be divided if you do not
jmake a will with contrary pro
visions prior to your death.
If your husband or wife sur-
vives and if in addition there
are surviving children or des-
cendants of previously deceas-
ed children the children and

With regard to real estate
the survivor obtains full title to
one-half and the other half is
divided between your mother
and father if both survive you.
If only one of them survives he
or she receives only half of this
portion and the other half (or

survivors.
And if there are no parents
or brdthors and sisters (and
their descendants) surviving
then the surviving husband or
wife inherits all of the real
estate.

ers and sisters and their des-

Where no parents survives
but there are brothers and sis-
ters and descendants the full
