This system for thirteen years
has done thojinnienso btibinecs of
I. e country. Within that limolho
F. Spencer and belies ing that the
suno weie in tho possession of
Gaudv called upon tho latter for
them. Ho had litem lucked up in
his own house claiming to own
them as his own and refused lo
deliver thetn lo tiic officer or give
him the key of the room so that
ho was compelled to break open
the door in oidei to Foiyo them by
viituo of the piocoss. It is true
that Gaudy offuicd no foieiblo to-
sistancc and made no threats against
the officer. But if his refusal to
deliver tho goods or Iho key of tho
loom in which they weie constitu-
ted an "obstruction" to tho service
of tho process by tho officer as was
charged by the C'omt then no
matter how ci loiicous the chaigo
may have been in other lespects
the votdiet of the jury was right
anil should not be set aside. Tho
act under which the indictment
was framed is that of the 30 Apr.
1790 entitled "An act for tho pun
ishment of certain crimes against
the United Slates." The 22d sec-
tion provides that "If any porson
or persons shall knowkijjly and
wilfully obstruct resist or oppoce
any officer of the United States in
serving or attempting to servo or
execute any ineasuie process or
wairant or any i uie or order of the
Couit of the United Stales or any
other legal or judicial writ or pro-
cess whatsoever; or shall assault
beat or wourd any olliecr or othoi
poison duly authorized in serving
or executing any writ ltile order
process or wairant aforesiid ; uveiy
poison so knowingly and wilfully'
olfemling in tho picmUes shall on
conviction thetoof be imprisoned
not exceeding twelve months nnd
fined not exceeding three hundred
dollars." In the ease of the United
States vs. Lukins reported in 3d
Washington C. C. Rep. page 333
the learned Judge says that the
provisions of the iirst part of this
section do not tcqiiiro that an assault
shall be committed in otderto com-
plete the olVo'teo. In this const ruc
tion of the Statute I think he is
light. It was tho duty of the de-
fendant in this ease to have opened
his stoie loom and permitted the
officer to seue the goods claimed to
belong to Spencer. His refusal to
doiFoj or to furnish tho officer with
the key of tho room was in niv
judgment an obstruction and resis-
tance to the officer in executing the
process and lcndcied the defend-
ant liable to this prosecution
whether he committed an assault or
imiule use of threats or not.

of the Cheap John Medical Colle-

of this grave abuse it has no light
to expect the Legislatuio to pro-
