trici Court in Fannin that claims against an estate
can never be barred until such publication is imde
An estate therefore can never be considered settled
until such publication is made. Most persons' ho
have heretofore advertised have omitted the date of
ihtir appointments which the law requires to be
stated.

From Mexico AMexican paper of the 7th No
vember contains the third prnjet fur a Constitution of
Mexico reported by the Committee oFthe Congress
and which was referred lo the consideration of the
committee of the whole. A hasiy review of its pro-
visions convinct-s us that it is essentially democratic
federal ir. its main feature a and embraces the cardinal
points of the Constitution of 1824.
The Diario del Gobierno of the 5th takes great
pleasure in stating that all the difficulties between the
the United States and Mexico have been definitely
settled. Gen. Thompson is highly lauded for his
conciliatory and urbane course in producing this de-
sirable result.
Accounts had been received from Tobasco to the
Gth of November. They announce that scvtral at-
tempts had been made to produce new revolutions
neainst the authority of the central government.

out the lepublic and the expense to be defrayed from
the public treasury.

Tornell Secretary of War has revoked the order
and commuted their punishment in 10 years impri-

ed to Perote. and it was believed would be well used
Gen. J. Pincksey Henderson. The investi-
gation of the charge against this gentleman for the
killing of Napoleon B. Garner came on before the
investigating court consisting of John H. Lewis J
T. Patterson and R. Whittlesey Esquires on Friday
last. The testimony was quite voluminous and the
trial lasted till late on Saturday night. It will be
gratHying to the numerous friends of Gen Hender-
son" here and abroad (o learn that after a full hearing
of all the test.mony it was unanimously pronounced
by the court a case of clear justifiable homicide a
decision that was received with applause by those
present and is very generally approved by the com
munity Geneial Henderson the moment alter Gar-
ner was Killed surrendered himself to the civil autho
rity ami dena ded a full investigation of the whole
transaction which terminated honorably to himself
and resulted in his entire and unconditional discharge.

Sir Through your kindness I hare been allow-
ed an opportunity of seeing an article copied from the
Nachitochcs Herald into the Louisville Journa1 with
the comments of the editor of that paper on thcsimc
The charges are of so grave a character that I feel
compelled to notice them publicly not so much for
my own vindication as for the purpose of disconnec-
ting my Father's name from the imputations which
the editor of the last named Journal would if possible
cast upon it. It is most unpleasant for a prirate in-
dividual to find himself forced to appear as a champi-
on in a public print for the purpose of refuting accu-
sations maliciously or falsely charged upon him;
much more unpleasant js it when those accusations
are founded upon it discretions of which but few-
young men are guiltless and which the public at
large care but littles about. Nothing but a sense of
what is due to friends abroid and to friends nearer
home w ha have so generously extended their coun-
tenance and support to me since my short residence
in this country could induce mclo notice these char-
ges But when nisfortune ;s tortured into crime
and malignity gloits over the transformation it is in-
cumbent upon the subject of that misfortune to rebuke
that malignity as publicly as it may be expressed
I-Viv have passed through the ordeal of this world's
fire and emerged unscathed fewer still have plung-
ed into the excesses of life without leaving some stain
which ttie microscopic eye of envy could not detect
or political scandal dilate upon I do not profess to
beinore frcefrom censure perhaps notas much so
than othcis who have had the same opportunities or

word obnoxious to the charges which the editor ol
