the property belonging to said estate bond and security may

husland is wasting or mismanaging or is about to wasto or
mismanage said community property or is about to remove it

for the proper management of such property and with such

Suction I. Be it enacted by the Legislature oj' the State o
Tcjms. Thai section M of tlio above entitled act hhall be so
amended as to read as follows :
Said Board of Commissioners is hereby authorized to invest
said funds by loaning to any such company which has been
liorotofoie ehartoied for tho puipose of building n railroad in
the Stute. the sum of six thousand dollars per mile for each
and every mih' of railroad constructed us hereinafter provided.
Said loans to be seemed by the bonds of such company for
said principal and interest made and executed to the State of
Texas in the corporate name of such company signed by the
President and countersigned by the Secretary or Treasurer
under the seal of such company : which bonds shall consti-
tute a lien upon the road and charter rights of such company
including tlio road-bed right of way grading bridges iron
rails equipments and masonry and upon all the stock sub-
scribed for in said companies all the depots and depot sta-
tions and all the property owned by such company as neces-
sary for its business. And the State of Texas upon tho exe-
cution of said bonds and by the virtuo of the same shall bo
invested with said lien or mortgage for the payment of said
bonds and the interest thereon as tho same becomes due
without tho necessity of any deed special contract or act of
registration.
Sec. 2. That this act take effect and bo in force from
and after its passage.

V DEAF AND DUMB ASYLUM.
An Act to establish an Institution or the education o the
Deaf and' Dumb.
Section 1. Be it enacted by the. Legislature o the State o
Texas That the sum of ten thousand dollars be and tho samo
is hereby appropriated and set apart for the establishment of
an Institution for tho education of tho Deaf and Dumb of
Texas which shall be located at the city of Austin.
Sko. 2. A Board of five Trustees shall be appointed by
tho Governor whose duty it shall bo to administer tho funds
of said Institution and provide for its going into operation as
soon as practicable by routing a suitable building and appoint-
in" such Superintendent and othor officers lis may bo required
for tho successful management of said Institution.
Sr.c. 3. That said sum of ten thousand dollars shall bo
paid oil tho order of said Trustees approved and countersigned
by tho Governor out of any money in the Treasury not other-
wise appropriated as tho actual current expenses of maintain-
ing tho Institution shall accrue. Provided that not more than
fivo thousand dollars shall be expended in any one year.
Sec. 4. Said Trustees shall be and they are horoby requir-
ed to mako full and accurato annual reports to tho Governor
of tho Stato showing tho condition and progress of tho Insti-
tution with u full exhibit of all expenditures and it shall bo
tho duty of tho Governor to lay tho samo before tho Le-

hundred and sixty acres each. And in dividing any tract if
there shall be nnv fractional balance of less than one hundred
and sixtv acres lite same shall l uttuched to the avljoiniiiK
tract. The Surveyor shall cause the lines of each tract when
thu same are in the timber to bo plainly marked and shall
establish the cottiers of each tract with good ami substantial
materials. He shall make a man of said work and field notes
in which each tract shall bo numbered and the quantity there-
of stated; tho lines and cornel's shall be fully described ; all
streams of water shall he stated with their course ; and the
point or points at which they may intersect any line ; and the
quantity of timber and pmnie land and the character of the
same in each tinet shall be stated as near as the same can be
estimated ; provided that dividing said lands into one bun-
dled and sixty acre tracts shall consist in running section lines
one mile apart and establishing coiners at the end of every
half mile.
Sr.c. 2. When said map and field notes shall be complet-
ed in accordance with the provisions of the preceding section
the Surveyor shall record the same in a bound book to be kept
in his otViee for that purpose and return the original to the
Commissioner of the General Land Office who. upon the re-
ceipt of the same shall notify the Governor.
Skc. 3. After said map and field notes shall have been
made and returned to tho General Land Ollico as herein be-
fore provided for it shall be tho duty of tho Governor to cause
each alternate section of six hundred and forty acres to be
sold in lots of one hundred and sixty acres each at public
auction to tho highest bidder at the county seat of tho county
in which the samo may be situated ; provided such sale and
tho terms thereof shall first havo been advertised for sixty days
in two newspapers published nearest to the county in which
tho land is situated ; also in at least three public places in
said county ; and in at least one paper at tho seat of Govern-
ment ; Provided also that such lands shall not be sold for u
less price than three dollars an acre.
Si:c. 4. That the terms of such sale bo a credit of twenty
years bearing interest at the rate of eight por cent per annum
the purchaser to pay to the Treasurer of the State at tho end
of each year after the day of sale tho interest due on the pur-
chase money and ono-twentieth part of tho original purchase
money. The purchaser to give bond with two or more good
securities for the amount of the purchase money and intorest
thereon after which he shall receive from the person making
tho sale a certificate of his purchase and the amount and
terms thereof and whenever he shall havo fully paid the prin-
cipal and interest of his purchase the Commissioner of the
General Land Office shall issue to him and his heirs or assigns
a patent ; Provided that nothing in this net shall bo so con-
strued as to prevent any purchaser his heirs or assigns of
such lands from paying at any time ho may desire the whole
amount of tho purchase money and interest and so doing bo
shall receive a patent for the same.
Sr.c. 5. As often as any purchaser of said lands shall fail
to pay tho amount of interest and instalment of his purchase
when tho samo is duo tho G overnor shall cause the same to
bo Bold again after thirty days' notice by public auction to
tho highest bidder at tho county scat of tho county where
tho land is situated tho terms of such salo shall bo that'tho pur-
chaser shall pay in cash tho amount then due on tho land and
tho costs of tho salo and for tho residuo of tho pnrchaso mo-
ney ho shall havo tho samo number of years as there remain
to run of tho original credit intorest at eight por cent to bo
paid thereon annually and tho principal to bo paid at equal
annual instalments ; tho purchaser to givo a like bond And re-
ceive a like certificate as at original sales.
Seo. 6 If at tho re-salo of any tract of said land it shall
fail to bring an amount suflloiont to pay tho principal and in-
torest owing thoroon and tho costs of such re-sale it shall bo
tho duty of tho Governor to causo suit to be brought against
tho obligoes (ol ligors) in tho bond of tho original purclmsor for
such defioionoy and if it shall bring any more than tho principal
and intorest tlioroon and tho costrfof tho re-sale tho oxcess shall
bolong to tho party whoso property is so sold. At nny such
re-salo tho Governor may if ho thinks it nocossary for the
pntootion of tho rights of tho Stato authorizo tho laud to bo
brought in for tho Stato to bo hold and disposed of for tho
bonofit of tho University Amd

bo mado and all such agents shall givo bond with two or more
