circuit court for first degree mur-
der in connection with the ham-
mer ‘laying of Alex Smith. 20,

In describing' the altercation last
February 3. Bittle testified that
when the cab reached the out-
skirts of the city he handed Smith
a quarter, remaining in the ear.
‘Tie said the fare would be 35
cents. I said I had always ridden
for a quarter. He said ‘you won’t
ride for a quarter with me, you—
Then he grabbed my jacket pocket
with one hand and hit me with the
other,” defendant testified.
Bittle said the fight ensued, that
he didn’t remember how many
times he hit Sr'!1', V th d. sev-

At the conclusion 'of his testi-
mony, Judee Sam Wood asked
Bittle if he believed he was in
danger of losing his life during the
fight. He replied in the negative.
Only witnesses put on by the
defense were Bittle, four charac-
ter witnesses, and r man known
as Bigler Stoufer.
• The defense then rested and the
jury was ordered kept together
for the night.
