Congress endorsed this, and ail
the States except "otherwise
minded" Rhode Island accepted
the invitation and specifically
authorized their delegates to
fulfill that now familiar respon
sibility.
That is what the Framers did.
When they had put together
their Constitution, they wrote
and endorsed a Preamble which
made clear. with a brevity and
clarity unmatched in political
history, the grand purposes of
that document: “to make, a
more perfect Union, establish
Justice, insureDomestic Tran
quilitv. Provide for the Com
mon Defense, promote the gen
eral welfare, and secure the
blessings of Liberty to ourse!
ves and to Posterity."
To explain the document and
win ratification from the
jkates. Madison and Hamilton,
with some assistance from the
distinguished John Jay, dashed
off (the phrase is an accurate
one' eighty-five explanatory
“briefs" w hich they called The
Federalist Papers, analyzing,
explaining and vindicating
every article, clause and word,
of the Constitution.
Those "Papers" should help us
understand “original intent" of
the Framers; so, too, should
the debates in every State over
ratification. And when we reel!
how many members of the
Federal Convention and of the
State Ratifying Conventions
later sat on Federal and State
Courts, where they were called
upon to interpet the Constitu-
tion. we must conclude that no
other secular document in his
tory has been subjected to such
searching scrutiny as the Fed
eral Constitution.
The intent of the Framers
was thus clear from the begin
ning, e g it was clear where
the Framers meant it to be
clear and elusive where the
Framers preferred it to be
adaptablev to future circum-
stances or, as Chief Justice
John Marshall put it, "intended
to endure for ages to come and
to be adapted to the Various
crises of human afairs.
