FRANKLIN COUNTY
Commissioners take no action
on Purley fire department loan
By LILLIE BUSH-REVES
Optic-HeraUl Staff
Die Franklin Comity
Commissioners Court mem-
bers took no action to ap-
prove the purchase of a used
vehicle for the Purley Volun-
teer Fire Department at their
meeting Monday, Nov. 25.
Die lack of action was
deemed the only legal thing
to be done under the circum-
stances, according to Comity
Attorney Gene Stump. The
volunteers had taken the ini-
tiative to replace their small-
er unreliable tanker, which
they use to fight grass/bmsh
fires. They researched a va-
riety of sources to find a re-
liable vehicle, verified the
value through the Kelly Blue
Book system, and completed
a loan agreement with Pros-
perity Bank.
However, the process was
not approved by the comity
and the $ 14,500 loan was not
pre-approved and budgeted
through the comity. Die loan
requires full insurance cov-
erage on the vehicle, which
the comity does not cany on
any of its vehicles, accord-
ing to Judge Paul Lovier.
“I plead ignorance in
this matter,” stated Purley
VFD representative Mike
O’Brient. “It is not that we
were trying to do an end
[ran] around you guys, we
just didn’t know the proto-
cols for what we were do-
ing.”
Die plan was for the Pur-
ley VFD to use the rotating
fluids from the comity to the
Comity wide Fire Depart-
ment Association to pay for
the vehicle. Diose fluids,
$50,000, will not come to
the Purley department until
2015.
“We can’t obligate fluids
from future years that are
are not even budgeted yet,”
stressed Tina Phillips, audi-
tor for Franklin Comity.
A question of whether or
not nepotism might be an is-
sue with the purchase being
from a member of the fire
department was raised. Attor-
ney Stump stated that since
this was a volunteer depart-
ment and not employees of
the comity, that the nepotism
issue was moot.
Die answer as to what to
do about the loan was de-
termined to be nothing. Mr.
O’Brient noted that the de-
partment was already plan-
ning to pay the $714 per year
for full coverage insurance
cost associated with the loan.
The loan calls for a minimal
interest payment only for the
next two years.
Die comity’s name will
be taken off the title, leav-
ing the names of the Purley
VFD members whose names
are on the note responsible
for the loan. If the money is
available in 2015, then the
loan can be paid, the title
transferred to the comity and
regular insurance assumed
by the comity.
Meanwhile, the Commis-
sioners court approved the
sale of two old vehicles be-
longing to the Piuley VFD
and comity. The vehicles will
be brought to the Franklin
County Law Enforcement
Center and will be included
in the next internet sale of
items that can be arranged by
the comity.
Die two vehicles to be sold
are a 2001 Ford four-door car
that was inherited from the
South Franklin VFD, which
inherited it from the Frank-
lin County Water District.
The second vehicle is a 1991
Chevrolet pickup. Die comf
did not designate where the
fluids from the sale were to
go, either back to the Purley
VFD for equipment, or to the
comity’s general fluid.
hi other matters, the fol-
lowing action was taken:
- Approved crossing the
comity access road to lay a
new gas line to the Hagan-
sport Fire Department and
Community Center;
