leging : W. P. Darby and T. L. Cauthen doing
business under the firm name of Darby & Cau-
then hereinafter styled plaintiffs, complaining
of J. L. flarvey hereinafter styled defendant,
represents that plaintiffs reside in Lampasas
county, Texas, and that the residence of the
defendant is unknown, and for cause of action
plaintiffs represent that heretofore, to wit, on
the 29fch day of May, 1895, the defendant for a
valuable consideration, executed and delivered
to the plaintiffs, his certain two promissory
notes in writing, each for the sum of $164.65,
one due six months afterdate, and credited with
the sum^f$!75rfNov. 25th 1895, the' other note
due twelve month* after date and both of said
notes dewing 10 per cent interest from date,
and boih of said notes providing for 10 per cent,
attorney’s fees, if placed in the hands of an at-
torney ^or collection. Plaintiffs allege that they
have placed said notes in the hands of an attor-
ney fo:- collection. Plaintiffs further allege
that the, defendant became liable and promised
to pay :said notes according to their legal effect
and ten0r thereof, and that said notes have long
since become due and although plaintiffs have
often requested the defendant to pay same, that
he has Vailed and refused to pay same, or any
part thereof, except the said sum of $4 credited
on onej0£ Said notes. Wherefore plaintiffs pray
for citation, and upon final hearing hereof, that
they, have judgment against the defendant for
the amount due on said notes with interest, 10
per cem attorney’s fees and costs of suit.

its aforesaid next regular term, this writ, with
your igturn thereon, showing how you have
executed the same.
