the Legislature of the State of
Texas to provide for the establish-
ment and creation of hospital dis-
tricts; providing for the Gover-
nor’s proclamation and submission
to the electorate.
BE IT RESOLVED BY THE
LEGISLATURE OF THE STATE
OF TEXAS:
! Section 1- That Article III of
the Constitution of the State of
Texas he and the same is hereby
amended by adding to said Article
a new- Section To be designated as
Section 60, reading as follows:

such conditions as the Legislature
may fix by law, and to provide
for the support of said districts
by a tax on the ad valorem proper-
ties situated in said counties; pro-
viding. however, that before any
such district shall be created it
shall be approved by a vote of the
people in said district.”
See 2. The foregoing Constitu-
tional Amendment shall be .sub-
mitted to a vote' of the qualified
e’ectorate of the State at an elec-
tion to i>e held on the second Tues-
day in November, 1949, at which
election all ballots shall have
printed thereon (or in counties us-
ing voting machines the said ma-
chines shall provide for) the fol-
lowing:
’’FOR The Amendment to the
.Constitution of the State of Texas
authorizing the Legislature to pro-
vide for the establishment and
creation of hospital districts”; and
“AGAINST The Amendment-to
the Constitution, of the State of
Texas authorizing the Legislature
to provide for the establishment
and creation of hospital districts.”
Each voter shall mark out due of
said clauses on the ballot, leaking
the one expressing his vot» on the
proposed Amendment, and if it
shall appear from the returns of
said election that a majority of
the votes caat are in favor of said
Amendment, the same shall be-
come a part of the Constitution of
of the State of Texas.
Sec. 2. That the Governor of the
State of Texas issue the necessary
proclamation for said election and
have the same published as requir-
ed by the Constitution and Laws ot
this State. 52-3c

to Article I of the Conatitution of
the State of Texts, by adding
thereto another Section following
Section 15, providing that the Leg-
islature may provide for trials in
lunacy esses without a jury; fur-
ther providing for the aubmlssion
of this Amendment to’ the voters
of this State; prescribing the form
of ballot; providing for the procla-
mation and publication thereof:
BE IT RESOLVED BY THE
LEGISLATURE OF THE StXTtJ
OF TEXAS:
Section 1. That Article I of the
Constitution of the State of Texas
be and the same it hereby amended
by adding another Section thereto
following Section 15, to be desig-
nated Section 15-a, to read as
follows:
‘‘Section 15-a. The Legislature
shall have the authority to enact
all laws necessary to provide for
the trial, adjudication of insanity
and commitment of persons of un-
sound mind and to provide for a
method of appeal from judgments
rendered in such cases. Such laws
may provide for waiver of trial by
jury in cases where the person
under inquiry has not been charged
with the commission of a criminal
offense, and shall provide' for a
method of service of notice of such
trial upon the person under in-
quiry and of his right to demand a
trial by jury."
Sec. 2. That the foregoing Con-
stitutional Amendment be submit-
ted to a vote of the qualified elec-
tors of this State at an election to
be held throughout the State on
the second Tuesday in November,
A. D., 1949, at which election all
ballots shall be printed thereon:
“FOR the Amendment to the
Constitution of the State of Texas
providing that the Legislature may
provide for trials w thout a jury in
lunacy cases” and
“AGAINST the Amendment to
the .Constitution of the State of
Texas providing that the Legisla-
ture may provide for. trials with-
out a jury in lunacy casef.” Eacn j

said clauses on the ballot, leaving I
the one (1) expressing his vote on
the proposed Amendment. In coun-
ties or other subdivisions using
voting machines, the above provi-
sion for voting for and against
this Constitutional Amendment

shall vote on such machine for or
