Dallas, Feb. 1*5.—The Gould interests lost (he first skirmish
ir (heir battle to relain (he control of <ht* Texas and Pacific
Railroad when .lodge Meek in (he Federal District Court today
jdenied (he petition the stockholders of (he road filed late yes-
terday seeking to intervene against the receivership asked by
jlhe (rust company in New York. The court ruled I hat inas
much as (he stockholders and officials of the railroad were in
J accord on fighting the receivership, the interests of both would
be protected by counsel for (he officials.
The application for the receivership suit grew tail of a New
York trust company's allegation that the road was woefully in
arrears on payment of accrued interest on a mortgage held by
(he trust company.

Italian, was killed and two others in-
jured when fire destroyed the Ameri-
can Club here this morning. The blaze
